Daylight murder of Nepal Supreme Court Justice Rana Bahadur Bam: A Commentary

Maoists must have killed Justice Bam. In a criminal law case, the first and foremost element to determine is "intent" (motive, mens rea).

During the Civil War when Maoists were underground outfit, their prime enemy were Security Forces (Army, Police, Armed Police). They even managed to kill the Inspector General of Nepal police when he was jogging in the morning.

Maoists took over the government via a violent protest. Maoists removed monarchy so that no one can question or control them.

However, Maoists never could imagine that Law (the Supreme Court) would become the biggest barrier in their dream to capture state power and declare Nepal a communist nation. Since last year, after the nation plunged into anarchy, Supreme Court interfered to restore the law and order. The court time and again crushed the unlawful moves of the Maoists. Many cases against Maoists, including former prime minister and Maoist leader Babu Ram Bhattarai remain pending with the Supreme Court. After the CA was dissolved, only the Judicial Branch is active in Nepal. There is no legislative or executive branch. In order to change the outcome of the pending cases by creating fear among the Justices, Maoists must have killed Justice Bam.  There is no question about it.
