Is this accurate information?

NRN ID Card

The NRN ID card is being issued by the government as per the NRN law passed by the Parliament in 2064 and the rules associated with it (Niyamawali) passed by the government in 2066. The rules are framed by the government (cabinet) where as the law is passed by the parliament. The rules will have to be as per the law. Rules are framed to fill the gap where the law gives discretion.

As per the law there are two NRN IDs. One for Nepali citizens living outside and the other for Nepalis with Foreign Passports (for easiness termed PNO). These two categories are different not only as per Nepali law but also the prevailing international laws. In case of any incident with the person concerned the country notified is the country whose passport one carries.  So talking that the government has created two layers of NRNs is not that proper as in reality there are two layers. For example if a person were to be deported, a Nepali Passport holder will be deported to Nepal, A Nepali origin person with a foreign passport will be deported to that country.

The ID card is issued by the Ministry of Foreign Affairs in Nepal and Nepali Embassies abroad.  The Secretary and the Mission head are the issuing officers.

Position of NRNA on NRN ID

The NRN conference in 2007 had welcomed the passing the law as a step forward. Similarly the NRN global conference of 2009 also welcomed the regulations and called for implementation.  Our position has been that we will use and act per the law while at the same time work for changing them as per our suggestion. We have been making suggestions to the government and other appropriate persons and agencies to amend the law to include provisions as suggested by NRNA.

Our main contention at the time when the law was passed has been on the definition of NRN and the treatment Nepalis with foreign passport get. (For example the visa issue is not clearly resolved and the PNO can acquire property in a limited amount.

NRN ID and Dual Citizenship

NRN ID and dual citizenship are different issues. The NRN law can not provide dual citizenship right. As we are told by experts, the dual citizenship issue needs constitutional change. There are also issues on how persons with dual nationality are treated.  The NRNA position has been that  we are for dual citizenship and will work for it.

Nepali citizens and PNO for NRNA

The NRNA as a social organization does not differentiate between a Nepali national living in a foreign country and a foreign national of Nepali origin living in the same country..  We believe in once a Nepali always a Nepali. Both the groups identify with Nepal and are interested in the well being of the country. Our heart beats for Nepal. And the outside society treats us as Nepali. In legal terms they may have different status. But in social and cultural terms we have one common identity, that is Nepali. So we are one for NRNA

But in legal terms, they are different.  For example a foreign passport holder needs a visa to come to Nepal and the government of Nepal can deny entry to Nepal  without giving any reason but a Nepali passport holder does not need it and government of Nepal can not deny the person entry to Nepal.  A Nepali passport holder can live any number of days in Nepal, be engaged in any profession as allowed by Nepali law and become a candidate to any post as allowed by the law. A foreign passport holder is allowed to live in Nepal within the visa term, my not be allowed to some professions, or may need prior approval to do business and like that.

Cost and  older  proof that they will live longer in the foreign country. he Nepali citizens can also get longer duration card if the Validity of NRN card

As of now, The NRN card for Nepali citizens is valid for 2 years where as the NRN card for PNO is valid for 10 years (these are the validity of the cards  being issued now. But the law says that The Nepali citizens can also get longer duration card if they have such proof that they will live longer in the foreign country.  The cost of obtaining cards is 500 dollars for PNO and 50 dollars for Nepali citizens. Further 20 dollars is levied for registration.

What the NRN card entitles

The NRN card for Nepali citizens:

Establishes that the person lives outside of Nepal, so presently not a resident of Nepal

Entitles the holder Can use that card for doing business in Nepal in the capacity of NRN

Allows the holder to be involved in business with repatriation rights (Non NRN Nepali citizens are not given such facility), can send money without need to pay tax in Nepal

In terms of facility apart from establishing one's status it does precious little. The card does not deprive them the facility they enjoy as Nepali citizen. For example,   Having the NRN card one can invest in a venture with the right to take the profit or principle to the country from where the original capital had come. The person can invest in the same venture as Nepali citizen without the right to take the profit and the principal back.

For the PNO the NRN card allows:

To hold on to the property they had in their name as Nepali citizens (no need to sell to Nepali citizens)

To come to Nepal any number of times and live in Nepal any number of days

No visa fee at the time of arrival

Right to buy limited amount of property

Open bank account and do business in Nepal

The card in a way establishes the right of the PNO to have some rights in Nepal, but not the same as Nepali citizens.

The documents needed for getting the NRN card

For PNO

Proof that the person concerned was a citizen of Nepal or the proof that the person was / offspring of a Nepali citizen either a child or a grandchild (old citizenship certificate or citizenship certificate of parent and the document establishing the relationship

Proof of present Nationality (Copy of foreign passport)

Proof of Profession they have been involved

There is an item of information that asks to furnish the details and proof of relinquishing the Nepali citizenship. But they give the card even without this information. This is because, in the Citizenship law of Nepal it is said that if a person accepts the citizenship of a foreign country, then he or she automatically looses Nepali citizenship.

For Nepali citizens

Proof of profession/ business abroad

NRN ID and NRNA registration

There is a provision in the NRN act to register the NRNA. The NRNA can be registered only if it has 50 NRN ID card holders from 25 countries as members.  So even for applying for registration we need to have 50 NRN ID card holders as members.

There are certain problems or inconvenience (what to do with children, is not the price too high etc)
