USCIS Announces Extended H-1B Filing Period

On March 20, 2008, the CIS published to the Federal Register a change to the H1B filing process that will extend the H1B filing window.

Pursuant to this change, the CIS will accept new H1B petitions for five business days, starting April 1st. If the cap is reached during these five days, all applications received during this extended window will be entered into a random selection process (i.e., a lottery). If the 20,000 advanced degree limit is reached during the first five business days, USCIS will randomly select from those petitions ahead of conducting the random selection for the 65,000 limit. Petitions subject to the 20,000 limit that are not selected in that random selection will be considered with the other H-1B petitions in the random selection for the 65,000 limit.
