Filing I-140 & I-485

There is this news that The American Immigration Law Foundation (AILF) is preparing to file a class action law suit against the Department of State (DOS) and the U.S. Citizenship and Immigration Services (USCIS). AILF anticipates that there will be at least two classifications of individuals in this class action suit: (1) Individuals who filed an I-485 application in July 2007; and, (2) Individuals who did not file their I-485 applications in July 2007 due to the DOS and USCIS actions, but would have been eligible to file. AILF has anticipated that individuals who filed their I-485 application will be in a better legal position then those that did not file their I-485 application. So, my attorney is asking whether I want to file I-485 in this July 2007 to get in better class if lawsuit is successful. But I am not sure whether I should file in July 2007 or not because no one knows whether lawsuit will be successful or not. If lawsuit is not successful then I will be end up loosing lots of money. Because if I have to file I-485 again then there will separate legal fees by attorney and lot more expenses. And I am not even sure how it will impact my status of I485 if I file in July 2007 and got rejected. I don't know whether I should file in July 2007 or not. Can anyone suggest whether its a good idea to file in I-485 in this July 2007? Please suggest your valuable comments. Thanks, BK
