My friend is in a process of applying for H1B, but his wife who is in F1 visa has violated F-1 visa status by not taking full time courses for few semesters. However, she does not have a SEVIS I-20 and she iis not in a SEVIS system (her university's ISO has not updated her status in the SEVIS) When my friend apply for H1B, should he include his wife as well? It seems like his wife does not want to continue her study as it will take few more semesters to complete her study. What should they do? what is a consequence if she is included? is there any chance of rejection? please suggest..
