I hope I am wrong but I think the auto insurance money will be distributed only to cover the medical expenses and damaged property. However, if the driver who hit them (82-year old man) is found to be at fault, then he (and thus his insurance company) can be sued to claim compensation. Attorny's advice is definitely needed.
