Hi,

My mother is currently in US in multiple entry visitor visa. She was granted visa on invitation by brother to attend his graduation ceremony. He is still in F1 visa and we would like to extend her visa.

Question:

Can I (in H1B) use my bank balance when we apply her visa extension?

Which one is best options:

- Show bank balance of F1 holder.
- Show bank balance ofH1B holder even though intial invitation was actually send by F1 holder.

Appreciate your answer.

Thank you.

Sumi

I would go with showing bank balance of h1b holder as h1b is work visa and h1b holder making money makes sense than a student coming in f1 student visa. And, b1/b2 visa does not indicate any reason of coming here it is a visitor visa that's all matters. I suggest you waiting or asking for right people b4 deciding on it, but that's what we did.

My personal experience and opinion says that- it really doesn't matter whose statement. at USCIS, they don't care now since she is already here. The only thing they will care is what is the basis for requesting extension. WHat reasons? Why your mother need extensions - show that with valid and enough supporting documents. For Example if you or your bro is getting married soon, or you guys having baby soon. Just becuase she need extension or she wantsto stay more is not a valid reason.
But guess what, If you file extension before her i-94 expires, she can stay as long as USCIS takes time to make decisions. and they usually take time in b1\b2 extensions. So my suggestions is that when her i-94 is about to expire, keep 4 weeks of time period, and file extension. In worst case scnerio, if her extension is denied, by the time she receives her letter it will be another 3-4 months.

But then I read in forums that once extension is denied..any multiple entry visa like 5yr visa gets void..please share your experiences here..
