Hey Folks Currently I am working in an university as a programmer, I am in
OPT (OPT card expires on end of dec 09),
though I am eligible for OPT extension (STEM major), my HR department informed me that they can’t extend OPT because
they are not registered in e-verify
program. They are willing to file H1B but I am concerned that that duration H1B
approval. It seems H1B approval takes up to 6 months and my card valid till Dec.
I am worried if H1B is not approved before dec then I am gone lose my job. So
I need some suggestion, what to do? Has anyone experienced something similer ???  lonly

File H1B with PP...You will receive Approval or Denial within 15 business days if there is NO RFE..Some Univ are Cap-Exempt from H1b quota , so chances r that u will get it smoothly..
Relax and Enjoy !! There is no way in hell that You won't get the Reply within 15 Busness days abt ur approval or denial..If ur Univ is not willing to do PP then invest 1000$ bucks from ur pocket..Under USCIS rules and regulations u r allowed to pay the PP money from ur Own Pocket..
Just to clarify the Never ending H1b jargon PP: Premium Processing RFE:Request for Evidence. USCIS: United states Immigration and Immigration services CaP-Exempt: Certain univ and research institutes are Exempted from Congressionaaly mandated (65,00-Normal),(20,00-Advanced Degree Quota (if an individual graduates with MS and above from US Univ)

Don't worry you still have time to apply for H1-B. I don't know how the rules are now, but I remember hearing that even with your H1-B receipt(EAC) you can start working. I guess you can double check this with USCIS. My first choice would be to apply using H1-B premium processing.

If u r doin H1B transfer or u r doing H1B EXTN or in " cap-gap(before the end of ur OPT) Providing that H1b will be approved..if ur H1b is denied u will loose your status Retroactively"
