Hello Everyone,

Just needed some input on my situation. I am currently on TPS at the moment. I came here on F1, because of my accident I couldn't attend college and I lost my status. I have been married for 5 years. Recently my wife applied for AOS through employment and kept me as dependent on her application. Her application was approved and she got green card and mine was rejected coz of my out of status for more than 180 days.

So my question is, Can I apply marriage based AOS with her being the PR holder at the moment? Also does the same out of status apply to me on this application also since she is not the US citizen?

Any help would be highly appreciated.

Yes, same story until she becomes citizen, Consular processing may work.
