I have a few questions related to a citizen sponsoring his sibling's I-485.

1. How long does it take to get the application approved? By "approved", I'm talking about "approval" of visa(?) to book a flight.

2. When he files for her I-485, what are the documents required? The main concern pertains to income. Will his previous year's income suffice or is that something that's required down the road(5-7 years down the line when they go through her file)?

If the US citizen has already applied for I-130, got approved and priority date is current, the sibling in Nepal will get the information from US embassy in ktm to prepare for visa application which will take only few months and it is not called i485. If the sibling is already in US, he will apply for i485 which will again take few months.
But, if the US citizen is thinking of sponsoring his sibling now, he has to apply for i130. i130 processing time is around 5 months but the current wait time is 12 years for US citizen's sibling before he can apply for visa for green card or before they can apply for i485 if already in US.
For instance, if the US citizen apples for sibling's sponsorship (i-130) today, the sibling can apply for green card in 2027 per current time frame.

12 years? I thought that was only applicable to Chinese, Indians, and Filipinos!

Anyway, if he were to apply for her I-130, is he required to submit his income tax documents now?

That's the truth, it's 12 years. For filipinos it's more than 20 years.
he does not need to submit his income tax documents now to file i-130 for his sibling. The affidavit of support is needed when it's time to apply for visa (12 years later). His tax returns or income proofs are needed at that time to support for sibling.

@keyser....i am not sure if u can sponsor someone's wife.....just kidding...Priority date is always current for US citizen's spouse. If the spouse is in Nepal, as soon as i 130 is approved (typical 5 months), USCIS will send approval to US embassy in ktm and it will then inform the spouse to prepare for visa processing, so i guess 5-7 months after i130 application.

Punter, I believe a newlywed citizen also files for I-485 along with I-130, right? Wouldn't s/he be required to provide proof of income right away or can s/he wait until family petition is approved?

keyser soze bro,
until and unless i 130 (family petition) is approved u don't have to show any proof of income

PROOF OF INCOME is required when s/he files for adjustment of status i 485 if s/he is in
United States..
OR
Proof of income is required when s/he apply for immigrant visa outside United States, once they enter US they will get green card...

Hi sajha friends,
According to the instruction we have to file both i130 and i485, If the sibling of the US citizen is here in US at the time of application. Does it mean that the processing time is shorter than the sibling applying out from the US? Pls share your experience. Thanks
