Greetings Sajha Users !

after rejection of visitor visas couple of times for my parents, I am planning to file Green Card for them.
I pretty much got some ideas about the forms I need to fill & overall process.

with regards to I 864 / sponsor income requirements, I work for a company on hourly basis & I regularly get overtime ( not less than 15 hours per week) every week which pays me time & half with pretty decent wages. The HR manager can not provide me the written document for the overtime I get every week, its a company policy to let their employee get overtime, not often but in regular basis ( sounds odd but i think its the type of technical work that we do requires high frequency). Long story short, I DO MAKE enough money to sponsor my parents within the level of 2012 Fed Poverty level. But I read somewhere that I can not prove income based on BONUSES and/or OVERTIME.

I needed to prove at least 33k income to sponsor my parents according to # of household incl. of my parents. this is my first professional job after school, that means I DO NOT have enough income for the last 3 years since i was in school to prove my income of that level. In this situation, Basically i can see the available options as:

Options:

=>>Looking for some sponsor: which i did in local areas i live but not being able to find any comfortable person to whom I can ask for the favor (or even pay decent fee) meeting the criteria of either Citizen or Permanent resident
=>>Bank assets:which i personally belive one of the weakest proof eventhough the amount of money i needed to collect gonna be a large sum to connect the dot up to that level 
=>>Looking for another part time work: which i can not do because of the hours I work & classes I am taking.

Now, what you guys think i should do? is it some sort of Unethical Behaviour to persuade someone to sponsor my parents paying some sort of fees?? The chances of getting burden of sponsoring & back biting is certainly going to be NIL, especially we all know our nepalese society. There s a good chance of me making better money next year after finishing my graduate school, but on this case, I dont have choice, I got to act now !!!

Please Help !! I appreciate you guys help in advance

I'm not sure, but can't you prove your annual income by tax return (form 1040)? If you have more than the amount you require (33K as you said) in your W2s as annual income then there is the proof.

Sparty, I appreciate your quick response.

The problem is my last 3 years tax income has way less gross income than what s required, as i mentioned i was in school.

I think its upto you to show the W-2 from the past two years but as far as the sponsorship is concerned, they only require the recent tax year. Hence, if your total annual income based on ur Tax Return(Tax transcript) is over the poverty guideline for that year, you should be good. Get a copy of tax transcript from IRS, it doesn't annotate on the transcript whether the income came from regular or overtime.. Use that copy when u file I-864. 
Also, initially after you file the I-130 petition, you do not need to submit the financial documents as yet. Once your I-130 gets approved then they'll ask you for your sponsorship document... Possibly a year later or more(depending on your immigration status PR/Citizen). So, go ahead and put the I-130 in and by next year, your income will have gone up, as you said, and you should be all set. Best of luck!

P.S. Previous years' income has very little to do with sponsorship as long as you pass the current year Poverty guideline.
