TPS Advance Parole Travel Document Arrived but ...

It has the following "Travel Warning regarding Unlawful Presence" that says in summary shades light on being inadmissible for re-entry or adjustment of status."

My niece overstayed her visa by few months while awaiting approval of H1b which was eventually not approved due to delay in filing by lawyer (about 1-2 week) , however she got TPS instead. Now she wants to go to Nepal for few months, come back then reapply for H1b, greencard or F1..


If you had experience traveling on TPS Advance Parole Travel Document, please tell us how it was for you while returning to USA on TPS Advance Parole and advise if the risk is worth it...

Has anybody from Nepal with TPS AP been sent back from Airport in USA,

I have traveled once last year with an AP via Abu Dhabi Pre clearance. It was very smooth and quick. But they took me to the secondary as initial officer did not have paroled stamp. I hardly waited about 5 minutes and they called me and gave my passport without any question. So as far your TPS and AP is valid and no criminal record, you should be fine. I am again planning to visit Nepal but have not applied for AP yet.

Could you or someone else clarify if the TPS Advance Parole Travel Document involved overstay in US in your experience in Traveling to Nepal and returning to USA. This is the main point. 

As you are aware my niece had overstay by few months, she was planning to leave, however TPS came in the right time and rescued her...

This is definitely a tricky situation...

You just need to have valid TPS and AP while entering the POE. That's all.

If one has valid TPS and AP, then he/she doesn't need visa or other status to enter to USA, is it true?
