Hi guys, has anyone been or know someone who has gone to Nepal for H1B stamping recently? I saw some posts couple of months back which was really helpful. I just wanted to know if there are any chances of visa denial after the new administration. I am planning to go back but I am little hesitant that I might get denied.
As per my situation, I was picked in H1B lottery last year and I got approved this year before which I was in F1. Now, I am a full time employed with an IT consulting company though which I work at a client. My H1B is with my employer (consulting company) and my client does not provide a client letter. I also have a TPS (Temporary Protected Status) and have applied for Advance Parole which I have not got yet. Besides that, I have all the required letters and my pay stubs.

h1b is very risky these days i would say u have 30% chance to get approved, if desi consulting firm is ur sponsor then its a big red flag, direct clint letter ( not desi ) might give u big relief which u dnt have. so far there has been no issue in other visas but as far as H1b is concern its a huge risk go back nepal to get stamped.

if u have non it background( including engineering) then its almost impossible to get h1 stamped, but then if u have IT background as a major subject in university then answe these questions with confidence,
where did u study ?
what was your major subject?
how long u been working for this company ?( actual clint not desi consultancy)
what u do in job?
what ur annual salary?
do u have supporting letter ?( that u work in this conpany.. this long..ur pay.etc ..

if u answer these types questions confidently.. ur chances are high..
but, never in any conditions, mention that u work for desi consultancy...

I am not with a desi consultancy. It is one of the reputed consulting company in Columbus, OH. I did BE in Computer Engineering from Nepal and studied MS in Computer Science here. Also, I have 4+ professional experience in my field. It's just that I recently switched to H1B and want to go for the stamp.

hows is 4+ years work exp n jus applying for h1..r u working in opt extension until..if u have a clints recommendation lettres working with them u should be fine

I was working on CPT for a year and got H1B last year. Unfortunately, I won't have the client letter. I will have all the letters from my employer only (petition letter etc.). I also have applied for Advance Parole so if anything goes wrong, will I be able to come with that?

for most of the h1 interviews (it), consular look for direct client letters, recommendations etc, even the direct clint is not interested to provide such letters for short term consultants somehow people are able to manage those letter, so i still suggest you to get such letter by any means if possible. once h1 is denied its hard to re enter with tps. i had a friend with tps, he got refused with h1b n entry was denied...he was working with desi consultancy though he was not working with any direct clint that time but was employed with consultancy only ( in paper )

All,

My H1B picked up last year, approved, and working through consulting company based on Texas. I have applied AP through TPS and have not got AP. Now i have to go any how Nepal because i already booked my flight for next week and after two week i have interview for H1B stamping. My client also does not provide any kind of letter but i am planning to ask some kind of letter with my current client manager mentioning that i am working with them for the following task. I am not sure what will happen in the interview.

I am in a similar position. I want to go to Nepal for H1b stamping this year. I have applied for TPS AP. I will buy my tickets as soon as I get the trave documents. Good lukc and keep us posted on how it goes.

I went to Nepal.... Went to interview and after Two weeks my Visa application got approved. My AP still pending.

Honestly, i think it should be fine. I am working for a direct employer so it was little easier to explain that to the interviewer. I was back there around 6 months back. Luckily, the interviewer also was from the same city where I work, so we got to chat about his hometown for a while. In your case, I think one layer of client and consulting firm between shouldn't be a big deal. One thing, would be to do a mock interview to write down all the possible interview questions about your employer etc. and how you work situation is. They don't have much reason to deny if they don't see any misuse of the H-1B visa like underpaid etc in your case. I've seen people with multiple clients liked Hired by A. (H-1B sponsor), contracted to B, and working at C. That might be bit tricky to explain
