HOUSTON—A 25-year-old Houston man was charged with three counts of intoxication manslaughter late Monday in a crash that killed three teenage girls last week.


Prosecutors say Sajan Timalshina was drunk behind the wheel of a Toyota Camry when he ran a red light and smashed into a Ford Excursion on July 9.


The crash occurred around 1:30 a.m. as Timalshina was headed north on the Highway 59 feeder and the SUV, which was carrying two adults and five teenagers, was headed east on the Sam Houston Tollway feeder.


Two of the teen passengers – 13-year-old Avianca Cortez and 17-year-old Rashaunda Raleigh – were ejected from the SUV and died at the scene.


A third passenger, 13-year-old Detrihanna Davis, died the next day at the hospital. They were not wearing seatbelts, police said.


The other occupants of the car were taken to the hospital in serious condition and have since been released.


According to court documents, Timalshina failed field sobriety tests at the scene. When police asked for a voluntary blood sample, Timalshina refused, but officers were able to get an involuntary sample because the accident was fatal.


That sample was taken at Ben Taub about three and a half hours after the crash and registered a blood-alcohol level of 0.075, police said.


After performing a retrograde analysis of the sample, officers determined Timalshina’s blood-alcohol level at the time of the accident was between 0.127 and 0.162.


In Texas, a person whose blood-alcohol level is 0.08 or higher is legally intoxicated.


According to court documents, Timalshina gave a voluntary statement to officers after the crash, saying that he was driving his brother’s Camry, had worked a 16-hour day and was confused about where he was going because he was tired.


Timalshina told officers he’d seen a green light farther up the road and mistakenly thought it was the nearest signal when he ran the red light and hit the SUV.


In a second statement, Timalshina told police he’d had a 12 oz. Corona at his brother’s work just before 1 a.m., but he’d only consumed a fourth of the beer.


Police said a big-rig driver, who waiting at the red light at the time of the crash, saw the whole thing.


"When the light turned green, he noticed that the Toyota Camry traveling north was traveling at a high rate of speed and he felt that he wasn’t gonna stop so he stayed where he was at," said HPD Sgt. I. Izaguirre. "But the Ford Excursion didn’t see that car..."


One of the surviving girls, 14-year-old Necie Davis, described herself going in and out of consciousness after the crash.


"I felt the car hit the other car and then after that I just blanked out and when I kind of looked around and Avianca Cortez was laying on top of me and I was trying to see if she was still here," said Davis. "I was trying to get her up, but I couldn’t really move."


Davis, who was released from the hospital late Friday, said she and her friends were on their way home from a party when they were hit.


"We always went places with each other," said Davis. "I wish I could see them one last time at least. I didn’t get to tell them I love them or anything."


Timalshina's bond was set at $150,000

See, I can write snappy comments like yours. Someone here said it is people like me who is making Nepal so screwed up. Obviously, going by reactions here, I think Nepal has more people who are like you guys than me, since there is hardly anyone supporting my position in sajha, but you guys are in flocks.:)

When you create a blog , better use words appropriately because the heading itself give different sense than in the body. Though  I have commented earlier but it is not right.

He did not killed 3 people intentionally, Did he shoot and killed those people ??? But the thread says " A Nepali kills 3 in Huston" .

Dude,  it is an accident from DUI and 3 people got killed in the accident.

It's illegal to drink and drive.

It's also illegal to drive without putting seat belts (even in the back seats in the state I am in, not so sure about Texas).

We all know that seat belts save lives, so I feel that the seat-belt argument can be used to decrease the penalties he would receive if there's a good lawyer to argue for it.

Syanjali: You are just another fool here in sajha... Why would you feel uncomfortable calling Mr. Drunk Driver here a killer ? If this Drunk Driver were a pilot and crashed a passenger jet under influence of alcohol killing hundreds - that too in the fileds of Syanja additionally wiping out your whole damn village, would you still call that an accident in Syanja or wherever hell you come from?

I recently watched old Hindi movie, and some one says" ए गालीया दे रेही है या प्रसम्सा "? reminded me that movie. I am in the same position now.

Every one' parents are proud of their children and mine should not be different. I wish I could ask them and conform, I can not. But  you can and what ever answer you will be getting,  think exact the same answer I would have gotten  too. Thank you.

What do you think ? What is in name??? Am  I sarcastic ?

Why do we always put our own people in a bracket and act as if we are outside of that bracket?? Nepalese always fight, Nepalese always talk behind back, Nepalese this, Nepalese that. Aren't you a Nepali?

If somebody uses arguments that are so obviously out of the judicial logics, you gotta try using something that the lost soul can related to. If simple logic would have worked, we wouldn't be arguing this case.


You might be building a case about the penal system but your arguments are absurd and appalling.

So, in states where helmet is mandatory, let's say a person blindly fires some round of bullets. One of them hits a motorcyclist in his head and now your argument would be that the person is not guilty because the motorcyclist should have worn a helmet? In Texas, I think wearing seatbelts is mandatory in all seats. So, the defense can make a case to lower down the punishment, but you cannot argue that what he did is wrong and he should be sent to prison for years like everybody else has to.


Them wearing the seatbelt or not doesn't affect any other car/drivers, but the driver driving drunk affects everybody around him. Driving a car intoxicated is a crime that everybody knows about and unless such harsh punishment is instituted the cases cannot be curbed (believe me the incidence would go astronomically up if the law was not in place) and to me a law is not just to punish the criminal but also to set an example so that the crime can be curbed.

Poor guy, Made mistake in wrong time and wrong place. Rest of us must learn lesson from it.
 No Drinking and driving. But " नभोगी चेतिन्न " is our way of life?

when are you planning on drinking and driving syanjali? please let me know. I will wait for you on the other car without my seat belt on. I want to prove your point to these guys that being hit by a drunk driver while running a red light and killing people is not as bad as sitting on the passenger seat without the seat belt on.

Now, at least you are beginning to talk sensible. Before you thought I should be sentenced to jail for my words. If it was the kind of principle of justice you subscribe to, no wonder your sense of a proper justice system is different from mine.

Sure, the guy is guilty of drink driving, running red lights etc (if the report in newspaper is true). But I don't think the story is told in totality by the journalist. Journalists always look for sensationalism. I find it hard to believe that if the case is so open and shut the Texas police and DA and what not would have let him go so easily. Some Americans in chron.com seem to think that Sajan is rich and may have people in high places which allowed him to run away. I think that is ridiculous, but that also represents the feeling of some americans that, just like we think of Nepali justice system, they think American justice system is corrupt and notworking.

I also find 60-years long sentence appalling. I come from a country where 20 (or 33 in the past) used to be maximum sentence even for an intentional murder. Nepal is poor, corrupt,and law may be nonexist there, but there are something about Nepal that I admire, and one of them is that our belief that jails are supposed to reform criminals. We don't have death penalty in Nepal and that is also something I admire. I hope our police is better, court system is more efficient, but I hope we never do away with some of the beautiful principles underlying our penal system. And some of the chief justices of our supreme court, like Hari Pradhan, actually died poor. He also happens to be the most respected  justice of Nepali supreme court. Not everybody, everything about our penal system was bad, and there were good people involved in crafting these fundamental principles.

Dude, I still think you should be jailed for saying what you originally said. Obviously that's over exaggeration of my views but you get the point. You can come up with 1000 arguments and that still won't make it right.


As for 60 years, it depends upon how many counts of felony he has accumulated and the law is law. I also wish he had lesser years but if that's what the law says then that's what he gets.

60 years is harsh, specially after the driver knew he should not have driven drunk, got a driver's license and signed the damn paper saying he was going to obey the law. these lawmakers were probably drunk writing when they came up with that kind of law.

This is the blunder mistake made by the driver. I pray god for the rest in peace of the soul of three innocent children. And my bottom line is that driver should be punished, no matter where he hides. My request to all don't drink and drive.

I see whole bunch of arguments for and against the guy who just flew away, Hatred towards him. I feel really really sorry for both of the parties. The guy who had to flew might have some dreams but everything happened to him in the wrong time and also he didn't got any chances.


But any updates with the case so far???


I hope this kind of activities won't happen in the future.
