 H1B Fraud is Killing America. Act Before too late

 Please bring attention to US Embassy of Nepal for fraud  IT Consultancies here in USA. IT Consultancies hire fresh students who have recently graduated and are on OPT status training students by job placement course, false resume of 5-6 years which is marketed in job market. Candidate getting job in IT through consultancy don’t have to tendency to work in as internship and get the H1B sponsored from such organization they prefer shortcut to making more money and H1B in short time by joining such fraud Indian Consultancies. Not only that other fraud is also done like creating like creating fake cheques to maintian H1B.
 
• Has the American Job Market become this easy and less competitive  to get senior level IT job without even doing internship?? I would imagine senior level BA/QA/Developer/Java Programmer/Administrator or IT jobs would require at least real experience of 5-6 years where a candidate starts his career as internship by earning less money and then moves forward not make 35-60 dollars per hour unless he has degree from Top Tier Universities in USA.
 
• How can a person get H1B and get their visa stamped when this has been created on fraud and fake information? Because of this  fact fraud resume created by International student and Fraud IT Consultancy even good candidate with good degree from good universities and deserving ones who do not want to join consultancies are having hard time to get decent job.
 
How will this country be competitive and retain if such policy is applied ?????Basically this is fraud and this has to be stopped.
 
So I urge all the person who wants to work here in USA and not be a victim of these fraud person taking over deserving ones jobs by emailing about this issue to USCIS at

It is possible to stop this kind of fraud by complaining the embassy about the IT Consultancy Name and Person who is involved in this fraud so that eligible and deserving canditate can apply for that position.

what do you think ? they don't know about it. Obama Administration has recruited many people in Homeland security to crack down on this behavior. they are after both fortune 500 companies and consultancies. if you are working for any kind of companies, you probably got a phone call from the Homeland security for an inquiry. if you are not working for any kind of companies in the US, you probably are a loser and just spewing your frustration on the internet.

There are certain people I know who did not get enough girls in college compared to their peers. Definitely jealousy was there. Fast forward a few years, now those people are not making as much as the same party animals. New kind of jealousy here again.

What matters most is - do you have what it takes to get the job done? Irrespective of 2 years or 8 years of work experience.

 I am one of them, and I am proud I did that. But if you ask me - was it my choice? NO NO NO...But then what were the chances that I would get hired, and start making some money so that I can pay my CC debt, that I spend getting my degree. < 1 %.
Rahul hit the nail right in the place. If you are a 5-6 years experienced IT guru and cannot compete with a fresher who just took 2 months boot-camp training, then from where I see you are looser. All I know is that you should be able to sell what you got to offer.
And look at the positive side of it, if a fresher can do the job of a person which requires 5-6 years, think what that person will do for the company when he has 5-6 years of experience.

The only thing I would like to add is that this whole H1b or in that regard hiring temporary workers needs to be look at.
I know the company is the first place we have contact with and therefore anytime we don't get hired  becuase the topic was sponshorship, we get angry at them. Well, I want to defend the companies in this matter, because i dont see them going through all the legal 'jamalas and paper work' that comes with it. If you are a average or lets say above average and may be a talented one out there, and there are few people out there just like you then why would company invest extra along with lawyer involvement. I think USCIS can make this process more less painful to the employer so that hiring temp workers who needs sponsorship will be easy.

Every project that I worked, they offered me full-time, and finally when it was time to do all paper work, the only reason i was not converted, becuase now they have to file/transfer my H1b.

Himal mitra, instead of complaining and spending more time in this things, spend time polishing your talents. I understand that the whole H1b system is a mess, and it can be better, but then we just want to follow the rules....
BTW, mahile teyo 5-6 varsa ko resume banara kasai ko kehi bigaraya jasto lagdai na hai.. company le 5-6 vahnyo, mahile 5-6 varsa hale, inetrview vhayo, sabai question gare, kaam ma ni diya ko kaam gare....so does it matter where it says 10 -11 years or 1-2 years...

 Himal bro how do you think students fresh out of university will get jobs? You suggesy internship, but OPT students only get a year to do so. Kaam khojena bhane pheri college jane ki Nepal pharkane? It looks like you are getting frustrateed with your own personal situation, and therefore all the rant. If someone is better than you and can get a job based on two months training, who's at fault?

jasale payena angur amilo bhayo jasale payo angur guliyo bhayo.. ani himal mitra timile pani suru ma visa paune bela ma tyo sabbai nakkali kagaz banayeko chahi polera khayou. raja harish chandra banne bhaye tehi bata suru garum na ki kaso... I am not into IT neither have 5 years experience... but I am happy to see lots of our Nepali brothers employed through these consultancies...

H1b fraud or loophole je jasto bhayeni, compared to india, nepalese contibution 5% pani hundaina hola. ani bring attention to US Embassy of Nepal re.... ali ali Nepali harule paune job pani nepali lai block garera sabai Indian le nai khau bhanne plan garya jasto chha himal bro le.......

नेपाली हरुले consultancy मा किन काम गर्छन भन्ने कुरा बुझ्न पैला यो बुझ्नु पर्छ
 
१) प्राय नेपाली हरु ले कलेज पढ्दा ४० घण्टा काम गर्छन| दिनभरी काम गरेर बिचरa  फेरी पढ्नु पर्ने हुन्छ, राम्ररी पढ्न गारो हुन्छ, तेसैले प्राय नेपाली हरु average student हुन्छन
 
२) धेरै काम गरेपछि र पढाई पनि ठिकै मात्र भएपछि internship पाउन गारो हुन्छ, internship बिरलै दिन्चन कम्पनीहरुले तेस्मा पनि खैरे हरुले आफ्नै employee क सन्तान लै धेरै चान्स दिन्चन
 
३) गर्दा गर्दै ४-५ वर्ष बित्छ, कागज को एउटा खोस्टो लिएर कुनै tangible स्किल नाभेपाची काम पाउन गारो हुन्छ, त्यो पनि ३ महिना मा. अनि आखिर सबै धोति कै सरनमा जानुपर्ने हुन्छ|
 
४) रहरले कोइ जादैन, तर ५ वर्ष को ग्यास स्टेशन र क्यकितेरियामा हाड घोट्दा मन अत्तिसकेको हुन्छ|

This industry is dominated by dhotis, Nepali mula haru ley jati karaya pani kei hune wala chaina, humal bro ley nagare youta tellu bindas gari dinchha. If u really care ask ur senator to bring a bill to stop complete h1b thing for others than students. That way corporate will be forced to hire students as intern, train them and hire them. There will separate job caterogy for professional and beginner . Right now corporates don't want to spent money hiring beginner , and companies like wipro makes money using immigration system.

But one thing for sure is fraud and fake in IT industry is costing respect/job quality and professional growth . This is the reason you number of natives working on IT going down everyday.

And also himal bro- this fraud in not on H1b side. You don't need 5 yrs exp for h1b. The fraud is on resume padding side, which corporates or even hiring manager can easily avoid if they want. And if they don't care what's the problem for other.

Why hire someone and commit for the pay, benefit, and go through the process of laying off once not needed than hire someone for 3 months and get rid of him if he does not work out. This is the drive for US Corporations. Now the US corporation, IBM for eg,  a big one is not going to do the dirty job himself, IBM will find another company who will do the dirty work of labor abuse and h1 fraud ...then there comes the role for dhoti. A dhoti will either do the dirty job himself or even put a layer next to IBM and find another street dhoti to do all the h1b fraud and dirty work for them. This way if things go sour the clean dhoti will be safe and only the street dhoti gets caught. Now this Street dhoti are the ones who are approaching the new graduates giving them 6 weeks crash course and send them through.

Now, we have two kind of stree dhoti employment aspirants. Lets talk about the ones who worked 60 hrs a week at dhoti's store. Now we all know that these folks never really studied in school. They had a nerd who coded all of their programming homework. Now the Street dhotis are giving those guys a second chance. Now you can learn one subject for 2 - 3 months and tag along with your crappy college degree and call youself a college graduate with a technical expertise. Dhoti will market you with 5 - 6 years of fake resume and you have a job now. This stuff is really good for you.

Now lets talk about the other types who took their schooling seriosly did all their homework, did not work as many hours at the store and is hoping that they would score a job once they graduate. But guess what, when they graduate the whole market has been corrupted wtih fake resume and Dhoti's monopoly in IT industry. This guys is not going to find a job. So the current setting is really bad for such students.

There is no need to notify INS, Embassay or your senators as they all know what has been happening since last 10 years and it is exactly the way they want it to happen. The politicians job is to provide cheap labor to corporations and corporations are getting them with the help of dhoti. If they make the h1b laws stricter the cost of contractors will go from 40 bucks to 80.00. This fraud/abuse is the way that provides cheaper labor. They can showing it to American people that they are following the H1b Guidelines (not being able to hire an American for the job) and they are letting H1b companies do whatever the fk they can to lower the cost.

So this is way beyond pity dhotis and us Nepalese. There is a bigger politics and economics behind it.

 २००८ मा, कतै जागिर नपाएसि एउटा internship पहिले नै गरेको र ओ पि टी भरि (खास त घण्टा हानेको) एक बर्षको दामी experience छ, आफ्नै साथीको under मा काम गरेको हो भनेर resume बनाएर फाल्देको, तुरुन्त कल पनि आयो. तर पुरानो resume पनि पो कताबाट पुगेको रहेछ त्यो संग. राम्रै शब्दमा यस्तो नगर्नु त भनी तर आफ्नो त सातोपुत्लो उड्यो त्यो बेला.

How can you say this while the client is paying huge amount of money for the job. Ya the consultant will just get about $40 but in reality the client is paying about $70/hr on an average.

I have one quick question,  if the consultant goes to work with 7 yrs on his resume but in reality he don't have any exp. And if the client comes to find out this guy is cheating and cannot perform and just wasting their time and money then can they sue the consultant with fraud charge ?

 just wondering and i'm not suggesting anything here, but if  it wasn't for these fake consultancies and fake resumes wouldn't there be more h1b quatas for for F1 students? IT market would have to lower their fake standard of 7 years andwill take you guys in and train you for the job, and you would have more respect and less stress than lying everyday at work. 
IT consultancy is no worse than IT slavery in the name of h1b.. you move from one place to another, always worry about getting caught at work, and someone is taking 70 % of your check for 2 months of training that someone gave you with googled materials. plus if you want to be most dhotis willt ake you to court and sue you and stuff.. when the matter of fake resume comes they can always say you boasted the resume to them as well.. they are not dumb.. they will say you produced that fake resume youself and lied to them as well so they are victim in the case , and the blame goes all to you...
no offense, it might have worked for some ppl but i see lots of ppl in bench, worried sick all the time and lots of them get sick of sleeping in bed bugs motel and made fun at work and come back to F1 status for second degree of masters while working at gas station rather... 
they are the source of problems, because they exhaust the h1b quotas and forcing you guys to be their slaves. they are not helping you but rather leeching you in the name of security . don't forget  they created the insecurity in the first place...
just my 2 cents.. trust me i 've been a student in this country for a long time and i know how tough it is...
