Hey guys!! I will be eligible to apply for citizenship in Jan 2014. And I need some help regarding my dilemma about whether to apply for citizenship or not.. I don't know a lot about how it works as if I will loose my citizenship in Nepal and wont have same right and also about owning any properties in Nepal? Any suggestions will be appreciated. Thank you guys.

The problem with Nepal is that the politicians who are supposed to make and uphold laws are busy filling their own pockets so noone really cares about anything. You could get a US citizenship and keep property in Nepal since noone bothers checking if you are still a Nepali citizen or not. If you have Nepali nagarikta then that's all you need.

This is the age when you ask not what you can give to the country but ask what a country can give you to. My advice is take the citizenship asap. Having US citizenship makes like a lot easier, you won't have to worry about being in status and filling in paperwork after paperwork anymore.

About the US passport, you have to listen to your heart.
For the property in Nepal, I wouldn't recommend you trying to buy/sell showing your nagarikta. I agree with US Citizen that no one will check for it. But if someone reports, you never know who will try to fish you, you will be in a big trouble. Rather, I would transfer the property into family members' name.

You can do some research on NRN cards http://www.nrn.org.np/taskforce/documents/nrn_card_evaluation_report_sept2010.pdf

The government has recently launched NRN ID Cards for Nepali people living abroad with foreign citizenship. This comes after the organisation of NRN held a week-long meet in Kathmandu few months ago. The cost of making this ID card is $500 dollars and the benefits which it brings are:
  • Visa Not Required
  • Allowed to acquire up to 2 Ropani’s of land in Kathmandu
  • Allowed to invest in Nepal
  • Allowed to acquire up to 8 Kattha of land in Tarai Nagarpalika
  • Allowed to acquire up to 26 ropanis of land in the Pahad region
There are criteria’s to be met ie, which I am still sketchy about. If you want to get your ID card then it is available from the Ministry of Foreign Affairs in Kathmandu or Embassy of Nepal.
They should’ve just implemented the Dual-Citizenship like many other countries, this would’ve made it easier, less-hassle free and it woud’ve saved all the time. Oh Well, im sure the government has their own agenda and so does the NRN.  Many Gurkha families in the UK are giving up their Nepali citizenship for the British citizenship available to them for the brighter future it provides. At a crucial time such as this, it wouldve been better to introduce the Dual-Citizenship since many will find it a chore to fork out another $500 for a NRN ID card.

BIG LOL to ujl. What are you smoking, dude? Most be something very powerful. If you see the whole world in mind, you are not outside Nepal, right? Even then just in the same spot where you were born, coz city, studying, better life doesn't matter because everything is inside your mind, right?

OP is just asking for suggestion, why do you have to shine (yea, right) with your illusion on everything?

If you don't have anything to offer, may be it's better to shut your p-hole. Don't you think?

May be you have to pay US somekind of tax if you own properties and business outside US. Read some news in bbc while ago but don't know the law of US.

It's a gray area situation. Different people will give you different opinions but from my understanding, a universally accepted bill hasn't been passed. If your main concern is about parental properties and other similar issues, you might wanna tread extremely carefully. In fact, I'd go on to suggest that you waited for a while as I don't really see any benefits of naturalizg unless you're planning on getting married or traveling to Europe (as most EU nations allow you visa free travel for upto 90 days).

If it's patriotism and cutting/keeping ties with Nepal, then you can't go wrong either way.

Thanks for your advise riddle. Yes I am mainly concern about parental properties and stuff and also don't want to have any problems with my siblings regarding all that in future even I trust them right now you never know things might change which happened to my parents with their siblings when they got married and started their own family.

If you become a US citizen, legally you are not allowed to acquire parental property. With NRN ID card, we can acquire certain amount of property according to the location as someone posted above, but only with the money you have earned abroad or in your case, in US. You have to show the proof of income for that. If you, anyway, acquire parental property but one of your siblings go ahead and report that you are not a Nepali citizen anymore, then you will be stripped of that property. If you want to be on safe side in terms of the parental property and want to get US citizenship as well, then you should first clear all the settlements of the property with your parents/siblings, sell all those and then become  US citizen. Otherwise, you have to take a risk. If you dont have any such threats from your parents/siblings, you can still keep them with your nepali nagarikta as long as nobody bothers to report. Another thing after you become a citizen here, you will be liable to pay taxes to US govt. on the income and assets you have in Nepal or any other country. So, you weigh your pros and cons and make a decision.

I guess your family is also eligible for citizenship. If so then why don't you let them be US citizen and you can stay in GC. That way you can buy property in her name and also you or she can also go back to either citizen. just my $0.02 thought.

If property inheritance is your main concern then you have no business naturalizing, just yet. What you could try doing is naturalizing w/o disclosing info about it with anybody else (other than your spouse). But there are risks involved.

However, if you got screwed after naturalizing, there's also an option of renouncing your citizenship. I'm not sure if Nepali govt. will honor it, though. Even if they did, you probably won't have it easy.

All things considered, I see no reason why you'd wanna get naturalized - especially if your spouse's immigration process isn't the root cause.

Good luck.

Note than an NRN card is subject to  terms and conditions that may change without much notice. I wouldn't place too much faith on it. For example, until recently, those with such a card did not need a visa to enter Nepal. However, they are now required to apply for a visa on arrival, have their photographs taken etc and are just exempt from the visa fee  - that too only because they paid the $500 fee for the NRN card. If this is anything to go by, the other benefits too could change over time as well.
