Mine is pending for 3 months in NSC. NSC is slower than TSC. From the people's experience that I know, TSC approves i485 before approving EAD. So I would say 2-3 months in TSC. NSC could be 5-6 months for i485 if no RFE.

No need to worry unless employer withdraw your petition. if they ask for employment verification letter, your employer must be able to provide one saying that they are going to hire you for permanent position after you receive your GC.

As I am working in % basis, they are not going to pay me if I am out of project. So, my question is do we need to run payroll in H1B or not? Can I be in vacation until I find project?

It has been 110 days waiting for i485 approval. Received EAD and advanced parole a month ago. Few months ago i485 process used to be quicker. People used to get GC within 90 days but now it is very very slow. It may pick up better next year if EB3 ROW don't get retrogress. Looks like there is a lot of application filled

Holy shit , I've seen people approved withing 2-3 months This site shows that application filed around September have started to receive their approval. https://www.permchecker.com/th... My labor was approved within 2 months of filing date. It was filed at the end of July this year and got approved on mid September. Filed i140(premium) and i485 concurrently about 3 weeks ago. i140 got approved in less than 2 weeks. Now waiting for i485.

@fdpower My employer filed i140 after little less than 2 months of PERM approval. I485 was filed concurrently. I honestly do not know much about filing for dependent. Someone else can probably give you better advise on that.

@Nepalisajha3 I don't think there is any definite way to say which one is faster besides going by the processing time in USCIS website. Currently, NSC shows processing time as April 2, 2016 and TSC shows March 23, 2016 for I485. But every case is different. So some may get processed faster than the others regardless of which service center. We just have to sit tight and wait I guess.

i follow the trackitt.com site , and have seen a trend where TSC is processing 485 in 3-4 months, and a lot of discussion by people that NSC is still processing case from june-july even thought the uscis webiste shows the processing time for both around the same. i wonder why my employer said NSC is faster.

@Sajha keto Normally you should get receipt by 2 weeks after checks are cashed. There was thanksgiving holiday in between so I would wait for a week more. Hopefully you get it by then. If not, I would call and check with USCIS (fdpower bro will kill me for saying that lol).

I got an update on i485 application today for EAD and AP. Application sent: 11/03/2016 (i140-premium and i485 concurrent filing) Receipts for i485, EAD and AP: 11/11/2016 i140 approved: 11/22/2016 EAD and AP card produced: 12/01/2016 I was under the impression that biometrics happens before they produce EAD and AP. But, I did not get biometrics appointment. Maybe they were able to use my TPS biometrics.

@nepals Mine is solely based on TPS status. My application for h1b did not get picked in the lottery twice. I was about to go back to school, then TPS happened. So my employer applied for GC after that. Labor was filed at end of July 2016. I had nothing but TPS.

Hi guys, I got a situation. I will really appreciate if someone provide me some good advice. I am solely on TPS EAD which is going to expire on December 26, 2016. I recently applied for I-765,I-131 and I-485 through EB2. Receipt date for all documents are October 31, 2016. Check already cashed out. I am desperately waiting for EAD card to come before December 26. I haven't received any fingerprint notice yet. Anyone in the same boat just waiting for GC EAD without applying TPS EAD? Is it ok to work with expired TPS EAD as stated in Federal register? Or to be in safe side should i apply for TPS extension for EAD? I would really thankful to you guys for any kind of inputs. wavernepal, Though I am not in TPS, they could be using ur recent biometric that you did for TPS so you may not have received ASC notice.Also, as check has been cashed, you will receive notice very soon. This is just my personal thoughts based on my experience. I still believe that you will hear something about GC EAD very soon so there would not be need of TPS EAD. But, still to be in safe side, consult with your Attorney who filed ur GC and ask for the best option

I got my AP and EAD approved before my biometrics as well. My wife got it 3 weeks after fingerprint though. Got approved on November 12 but my appointment was on November 18th. I received my card on 19th one day after fingerprints. I was surprised as well. But now I am waiting for I485 to get approved since then. My I40 got approved on mid November there was RFE on it which got resolved in 3 weeks.

I think they have already sent you the FP notice. Check with your attorney or HR. If they have not received it yet, ask them to contact USCIS. Most of the time, when this message gets updated, people receives FP notice within a week max.

Hi Guys, Looks like USCIS sent me an approval notice for I-765 along with card but they didn't deliver it yesterday. Maybe they didn't see my name on mail box. I checked my case status online and found that "On December 28, 2016, the Post Office returned a notice we sent you for your Form I-765, Application for Employment Authorization , Receipt Number LINXXXXXXXXXX, because they could not deliver it. This could have a serious effect on your case". I talked to USCIS representative and she said my I-765 was approved and card was sent out. It has been 140 days I filled my i485 from NSC. Still it is pending on "Fingerprint has been received". I heard if you are filling for your spouse it takes longer than you file alone.

@nepal_nepal2016, You seem to be lucky buddy. I have my RD on 14th Nov but no updates after FP is done. No EAD/AP so far. I-485 is not country specific. If you are lucky like your EAD/AP, you are likely to hear within 3 month. But, I am following some other forums like trackitt.com and based on that NSC is slower than TSC. Lets hope for the best !!! Regarding your EAD, you can now work two jobs. You can change employer if you find a similar job but not recommended. Wait till you get your green card and enjoy.

Thank you roomrent969.. I did not hear from USCIS for two months so I put my information in USCIS website to check my status and it said cannot Create ticket or something like that. And I got text with in couple of hours about my case. I did the same thing for my wife's case thinking if it was coincident /luck and hers status information was sent with in 3-4 hours as well. I don't know if my status checking through USCIS website has anything to do with it but I suggest you to do the same. Best of luck

From my understanding F2A is current, the timline after filing the 485 depends on service center, I would say around 4-10 months.

@Nepals, I went early walk in as my wife was traveling back to Nepal. We directly went there. We had to wait ~10 min. I think it depends on which location you visit as well. I heard some people dont entertain for early walkin.

@wavernepal: Same situation here bro. NSC seems to be slow in processing both i765 and i485 as compared to other service centers. I got my EAD after 65 days ( received it before biometrics notice). My wife's EAD application has been pending since October 24. Let's hope NSC starts to process applications bit faster.

I have noticed i-485 getting approved quickly if your i-140 is already approved compared to concurrent. August is decent time frame considering having good luck. But make up your mind to wait little longer like somewhere around october.

that was NSC. A lot of people who filed before that are still waiting in NSC. So you never know. Concurrent regular filing RD on 10/07/2016 for TSC has approved I-485 already. i-140 for conncurent regular RD o 11/18 is already approved. On regular concurrent, After i-40 is approved, most of the i-485 are approved within one and half months. so good luck you all.

We had to reach out to congresswomen to reach out to USCIS on our behalf because I-140 was pending for a very long time and USCIS provided only generic response even after two service requests. Alternative was to go for an Infopass, but the first infopass is not too different from a typical service request. Re: RFE: This is an NIW case with my wife as the primary applicant, but I-140 processing time is not different for NIW (also no option to pay to expedite NIW-EB2). The RFE was subjective. The summary language was "your research has been cited as background information and not as the foundation for further research." Additional testimonials from multiple scholars who cited her work as the foundation of their work were needed. For that, over 75 papers who cited her work were to be reviewed and she had to find which of them have cited her work as the foundation of their work and not just background. Some 25 papers were shortlisted, out of which about 10 were strong. लेख्ने मान्छे पाउन गाह्रो भयो, बल्ल बल्ल लेटर लेख्ने मान्छेले धेरै समय लगाए, त्यहि हो.

I saw a case of EB1B case approved for Jan from TSC. Few EB2s from middle of december are approved recently. So my assumption is , they are processing around mid-december . All these cases I saw were non-concurrent ( i-140 approved before i-485 filing). So I believe it gonna take at least another month before they start touching EB3 for jan. Eb2 should be in couple of weeks. And add another month for concurrent filing ( non-premium). In some blogs, they saying EB3 are few months behind EB2 , but don't know how true is that.

Concurrent is faster than the combined time frame of I-140 and I-485, thats what I thought. But you seem right, in some cases , they getting approved faster. A non concurrent EB3 @NSC got approved recently with RD Sep 2016. So you should still be close as you are EB2.

For Nebraska, it seems like Murphy's law applies quite well. "Anything that can go wrong will go wrong". I had received RFE on i140, and again received rfe on i485 for birth certificate and bonafide marriage. Finally submitted rfe documents on April 21st. Haven't heard anything back after the response. @Sansarikmoha what raised a red flag in your case that triggered an RFE for a bona fide marraige? Did you not submit your marraige certificate? Was the marriage very recent? All of these RFEs seem so random and dependent on the mood of Immigration officer. Some people get RFEs and some don't even with the exact same situation. It sucks to be in this state of mind. I am also seeing a lot of Birth Certificate RFEs.  I have heard from my own laywer and other people that RFE turnaround is pretty good!! So let's hope you get your approval within this month. Murphy's law: To further add, I got a Request for Evidence (RFE) from USCIS for missing my 'Flu Shot'. The civil surgeon must have skipped recording my flu vaccine as I filed my I-485 during summer. Late winter when my I-485 application was supposed to be approved, it was put on 'hold' due to a missing flu-shot. Long story short, I took a flu shot and sent my updated vaccine record to USCIS. Got my Green Card approved within a week.

Congratulations c864916.@zeePa: The marriage was recent (about 6 months) but I had submitted marriage certificate along with the application. Looks like the officer wasn't satisfied with the certificate alone. Some ppl on trackitt had gc approved within days of response. Mine has been two weeks exact.No updates till date. Can I use my TPS EAD even I am waiting for I-485 approval based on Spouse I-140 case as secondary beneficiary? Lawyer was saying my non-immigrant status H-4 would be void if i use my TPS EAD. And other than that my lawyer won't help me answering I-485 case as did file via DIY package. Any suggestion and advice would be greatly appreciated.

Hi all, need advice. my h1b is expiring this july 14th. and my 485 is in process . 485 received date is nov 14th. i have already got my GC EAD card. my employer is asking me to file for h1 extension, which is another $1200 expense for h1 extension, but i might also get my gc approval soon too. should i change my status to GC ead and continue my work or file for h1 extension? My employer told me that if incase my gc gets denied, my gc ead will automatically be invalid/cancelled same day. so not sure if i should go for h1 extension or move to GC EAD ? although gc denial is only 10% chance. anyone have faced similar situation, please advice. please let me know who all have got their gc approval with received date of november, EB3, nebraska. when can i expect my gc approval for eb3 category?

Hello Nepali_USA, Here is my view/advice on your case. You are pretty close with your case. Based on the past data, NSC are processing applicants as of Nov 1st week. So, I think you should get your result by this week. Since, your first term expires on July 14th, why not wait until July 10. And, if you didn't hear anything from USCIS, then file for H1B extension. However, fill out all the docs and make it ready for H-1B extension. But, you have to pay for the lawyer ($1200) to fill out those forms, hmm. Gotcha.. If I were you, I would wait until end of the month as you are pretty close to your case. And, then start filling out H-1B 2nd term extension forms. PS: My H-1B first term expires this August 14th as well and my priority date is March 8th 2017 - TSC. I am hoping I will get my GC by the end of June/ Mid-July. I am thinking to wait until end of July and file for H-1B extension beginning of August. Yours one is cheaper ($1200), mine is like $1750. Good luck to both of us.

Here is a new update for I-485 ya all. I-485 Received Date March - 8th 2017, Concurrent Filing (Both me and my wife) EAD Received - April 27th coz I filed TPS (Late filing) and got RFE on TPS as well. Both EAD & TPS got approved on April 27th. H1B First term expired August 13th and didn't go for 2nd term. Started working on I-485 EAD since last week. August 18th - New Card is being produced. :) :) No Interview, No RFE on birth certificate (BC was on Municipality letter pad) Hopefully it will arrive by next week. :) Good luck for ya all. Finally a long wait is over.

Mine was received in Jan 20, concurrent I140 and I485, had to do premium for i140 after 7 months of waiting, approved in August end, still waiting for i485, TSC. Hope to get that magical text/email this month or next.

Congrats ! For some reason my file is stuck at NBC. Applied on Nov 20 , 2017, transferred to NBC on April 26 2018, after that nothing. Previously you could raise SR if it was after 6 months of application, now you can't even do that.

@Shelvey That sucks man, Did you try contacting the USCIS Contact Center? The NBC website reads --> "If you believe there is a problem with a case that you filed, you have moved, or you are in need of other services, the USCIS Contact Center offers a variety of Case Services for a case that is pending or completed." Usually, the NBC has your complete records of your petition (your entire file, since day 1). The field office has to request your file from NBC before they schedule your interview. May be the field office is just backlogged and haven't requested your file from the NBC. What is your Service center?
