hi guys, This time I am posting for info regarding issues of my friend. My friend is in Nepal. His girlfriend is in the US, she has a US green card. Now, what are the possible paths for his immigration to the US? They want to get married asap but the girl don't want to travel to Nepal because she has no relatives overthere. Please suggest all the possible ways for him to come to the US and acquire green card. Also how long it takes to process ? Please please help!!! Eagerly waiting for answers, thank you very much for reading and trying to help...

Walkahead mitra, First of all, thanks a lot for doing sriganesh to my post. Bhojpure01 bro, thank you and I am seriously asking the question. I know a little bit but want to know more options through sajhaties' personal experiences.
Suppose, my friend comes in a student visa and marries his girlfriend who has green card, what happens then? Will he get a GC too? I think he can get but not so sure so asking here in sajha. If he can get, then how long will it take? Is it certain or uncertain that he get a GC? Please help!!!

furke dai the best way i think is for the GC girlfriend to go to Nepal, get married, get marriage certificate, come back without the husband, file I-130. nowadays the green card for spouse of greencard holder is about 8 months waiting period.They are processing I-130 filed in january 2010. http://www.travel.state.gov/visa/bulletin/bulletin_5113.html maile jaanya yetti ho! bhul chuk line dine hai sir,

How long before the girl is illegible to apply for naturalization. That would be the best bet and lot faster, depending upon the fact that girl does not have long time before she qualifies to apply for citizenship.naturalization. Otherwise lots of delay and hassle..... Hope this helps!!

Here is what i know: There is no direct path for your friend to get a green card unless the primary becomes citizen. As of now primary can file I-130 which will be approved within 6-12 months but getting I-130 approved does not mean that your friend can come to us or will get the green card right away cause there are lot of people awaiting before your friend, as us only issues certain number of visas per year for that category. So approved I-130 is just a confirmation that he/she will get the immigrant visa once its his/her time cause its based on first come first serve basis and yes as per per country quota as well, so Nepalese may enjoy benefit over other countries with high population. Please consult attorney for in depth of immigration, Gurus please correct me if i am wrong.

As said above there's a long wait for GC holder to bring their spouse in the US. But since last few months the wait time has significantly decreased and as per current processing time of DOS (Department of States) the F2A (family preference #2 category visa for spouse of LPRs) processing time per October visa bulletin is Apr. 2010 meaning there is 6 months back logged, but these can be retrogressed in the future. Furke, If your friend gets F1 visa and get married here in the US, his wife always can file I-130 for him. The processing time for I-130 is 5 months these days (for all four service centers). So, according to the current wait time it takes up to 5 months to get I-130 approved and another 5-6 months for visa to become available in his case, after that he can apply for the immigrant visa. Brothers and Sisters of US citizens fall under category 4. The current wait time for that category is 9 years (almost). If your siblings are unmarried and under 21 yrs. of age then it would be much quicker if your parents apply for them after they get their GC. It's spouse and children of permanent resident; category F2A. If your siblings are unmarried but 21 yrs. of age or older then it's F2B (Unmarried Sons and Daughters (21 years of age or older of permanent residents): As you can see on the table they are currently processing application filed on or before 01 APR 05 in this category. Married sons and daughters of citizens fall under category 3rd.

@leader guru, thank you la sir. Ani ni sir, if he comes to US in a tourist visa from Nepal, and marries the girl in US and leaves the country as per I-94 stamp date (like within 6 months in most cases) and flies to Germany who is a permanent resident there, now k hunchha? His wife can file I-130 for him and can he apply for immigrant visa from spain or he has to return Nepal?
