 lost passport and f1 visa in usa

im currently studying in texas in a comunity college. I ve quite a big problem because yesterday my passport got stolen from my friends' car. outside our apartment somebody broke in my friends car and stole my bag in which i had some money and passport. i was planning to visit nepal this summer and i ve already booked my ticket. i am applying for my new passport tomorrow but im not sure if my visa and i 94 will be re issued from here. hopefully i ll get my new passport next week but i need a  visa and i 94 to travel to nepal and come back. so, please help me with my problem and tell me if the immigration issues f1 visa. and i 94. if not how can i get visa from here ASAP and from where and what documents do i need!!. if i go back to nepal may be ill be rejected for the visa cuz i transferred from my first college to a community college. i also heard that they issue passport from mexico or canada . plz tell me wat are my chances to get visa from here. i ve never been out of status and i just ve been here for 2 years and my visa was for 5 yrs. so plz help me.

I don't have experience about this,  but I think you have to call Nepali embassy as soon as possible telling everything what was happened . They will tell you what you have to do. You can google about lost passort with visa too.

If you lost your passport, you have to immediately inform your international affairs of your college. They will send you along with the college documentations to INS, Coz they will have the photocopy of your visa and passport with them. So you have to go there and have to pay some amt(i dont know how much). the whole process will take around 5-6 months.(approximately). So dont worry... Hurry...........!!

Please do as Raxi suggested and once you filed your papers etc follow up on them every week or so..I am not sure but ask your college (International student advisor) to find out if there is an expedited process.  Hurry up...this process is time consuming and expensive....

yeah, i went to my college but they told me that . i can make a new passport from DC nepali embassy but for the visa i have to go back to nepal. international advisor of my college dont know anything. i know they give viSA from nepal but since ive transferred to a community college its a risk. so i want to do it from mexico cuz i heard that they give visa from mexico too. so anybody who knows about it .. plz help me!!!!!!

I guess Canada is better than Mexico. This is only my opinion. This is not a legal advice. There are some Law Gurus in sajha like Sajha Lawyer, Santosh Giri ji or ......... , please help him as he already booked his ticket. Quick question, Why you leave your passport in car? and I am pretty sure did police complain already.

yeah siju ji,
i needed to make copies of my passport for our new apartment. dasha lageko bela k bho k. yeah i did a police complaint already.
the reason i wanted to do from mexico is its near . ani im in status. and im not renewing my visa . mero visa was valid till 2011. i just want it to be reissued . khai k garne k. atti tension bho.

sumbody help me!!

Pidit007,Don't worry too much. You are in status and that's the main thing. Once you get yourpassport from the Nepalese Embassy in DC, go to a US Consulate in Mexico and apply foran F-1 visa. I am not sure how long the Embassy in DC takes to make a new passport; butI heard that these days, such processes don't take very long. Besides, you might already havetalked to them and have an idea when to expect it. Anyways, you have to go to Mexico to get a new visa because US Visas are issued only outof the US. US Visas cannot be issued inside the country. You can get better information onit through www.uscis.gov or by googling it. You will most probably get a new F1 visa from US consulate in Mexico since you have notbeen out status and you have a geniune reason: lost passport along with visa page and I-94.I hope you are also good (don't need to be that good but above avegare) in studies just in case they ask for your college transcripts. To get an idea of what documents you need to take, ask your international student advisor;he/she should know atleast that. Or have your friend from North Lake College (if you'rein Dallas) ask their international advisor for you. NLC International Office is very good and professional, so, they know every thing in detail. Set up an appointment at the US COnsulate in Mexico first; they should also have a list of documents that are required for Visa application on their website; so check them out.The entire process in Mexico, as I heard, is easy and is less time consuming. FInally, is you can email Mr. Santosh Giri through sajha. He is an immigration attorneywho is pretty helpful and keeps providing solutions to people's problem here at sajha.I am surprised that he's not yet responded to your thread; may be he's busy or something.Anyways, send him a sajha email requesting for help and he would be able to give you betterideas and suggestions or advise.Good Luck.

Pidit007,

Getting an F1 from Mexico for you is not that hard because you're an F1 student enrolled at a US college right now. You need a new visa because your passport was stolen. I am not 100% sure what documents are required, but I assume, just assuming, that you do not need all the documents you needed when you applied for the F1 from Nepal the first time. To be accurate and precise on the required documents, talk to your international student advisor or if he/she can't answer your answer the best thing would be to call the

1. USCIS; their contact # is available at www.uscis.gov. The customer service will provide you in detail what documents you will be requiring. My experience with them is that they are very helpful people

OR

2. The US Consulate in Mexico that you'll be visiting. Call them, explain your case, and ask for the list of required documents. They will also be able to help you.

I am sure you'll do this, but just in case, be prepared, write every question that you plan to ask them and also write down the asnwers for you own convenience.

 ani one more thing.
since my passport is lost. i also dont ve my i 94 . is it important to make another i 94 before i go to mexico for the interview ? this i 94 thing will take some time i guess. so i dunt want to waste my time on it if its not needed.
still confused!!!!

Pidit 007,I don't have a clue on the Paper Visa thing. It might be true, but I just don't have any ideaon it. Better you confirm (not just guess) with the source you heard it. Regarding the I-94,if it takes time, I think you can just submit a copy of it (if you have it; if you don't have it, it will be in your file with your International Office). And you can surely explain thecase (your lost passport and lost I-94) to anyone who would inquire). Furthermore, be sureto carry the Police Report specifically indicating that you "lost your passport and otherdocuments" due to a burglary. If possible, carry a reference letter from your International Student Advisor stating the incident and recommending an F-1 for you.Good Luck!

SajhaKoHero,I am not 100% sure, but I think, you do not require a Mexico visa if you're an F-1 studentfrom the US and are limiting your travel to certain "near-the-border" cities. The US consulateis located within the area in Mexico where you do not require Mexican Visa to visit.

You will need to replace your portion of the CBP Form I-94 or I-95, if it is lost, stolen or mutilated. If you are applying for an extension of stay or change of status, you will need to be issued a CBP Form I-94 or I-95, if you were not issued one of these documents when you first entered the country. See the U.S. Citizenship and Immigration Services (USCIS) Website (uscis.gov) for information on how to file for a replacement CBP Form I-94 or I-95.

Q: How do I apply for a Replacement Nonimmigrant Arrival-Departure Record, CBP Form I-94 or I-95, if the original was lost, stolen or is mutilated?
A: If you are applying to replace a lost, stolen or mutilated Arrival-Departure Record (CBP Form I-94) or Crewman's Landing Permit (CBP Form I-95), you must file an Application for Replacement/Initial Nonimmigrant Arrival-Departure Record (Form I-102) with the USCIS office having jurisdiction over where you are temporarily located.

If the CBP Form I-94 or I-95 was lost or stolen, submit a copy of the original CBP Form I-94 or I-95. If you do not have a copy of your original CBP Form I-94 or I-95, please submit a copy of the biographic/photo page from your passport and a copy of the passport page that was stamped by CBP officer when you entered the country. If you cannot submit any evidence of your legal admission to the United States, please submit a full explanation and proof of your identity.
