Hi guys, I'm in a dilema now that it's time to file for green card. In the biographic form I have to list my five years employment history. In the past I worked without authorization which will reflect so if I mention it, problem, if I don't mention it could still be a problem. Does anybody have similar experience where you have worked without authorization and had to fill out this form. I know it doesn't matter if you are filling for green card through marriage but I'm filling EB3 through employment. I know they can pull out all records and verify so don't wanna get caught lying.

dear kastamandap,
I had exactly the similar situation. Believe me. I mentioned every job i had which i did without having Permit. Since you were legally staying and studying in the USA, they won't go further down. Its just for finding any high level crime. It really doesnot matter.Trust me i did not have any problem. I got mine without any hindrances.Fill what ever you had done in the past.

Good luck do fast... Every day counts for you guys. Its gonna be over before August 1st,07.

With two different opinions I'm still in a dilema, though I'm inclined towards letting them know the facts, I don't rule out offline's suggestion. Anyway, thanks guys for letting me know your experience. If there are more Nepalese with similar experience, I'd be happy to hear. And Jayamatadi congrats and all the best to you. Let us know when you get your green card. Thanks everyone for replying and I hope more will discuss on this topic because I think it is a common choice most make.

Hey Sum, did they call you for interview? or is the interview waived for EB3. Did you not worry about it? I'm too much worried. You know they can track everything if they want too. Did you have to submit your tax returns too?

mine was family based.my parents are permanent resident. i changed my status while i had f1 status. interviewer asked me what i was doing in ocean city during summer. so i told her that i was working illegally due to financial problem. she was not pleased but i got approved. It might be completely different situation in your case though. Thats all i can say.

Worst come worst, you have to pay $1,000 fine for working illegally. Talk to your attorney, he will advise you if you need to pay that $1,000 or not. Good Luck!!

Today I was filling out the I 485 form and it specifically mentions in the instructions that one cannont file if you picked up unauthorized employment, however in the questionaire there are no specific questions on unauthorized employment. I really hope I can escape through this without trouble otherwise you know how much tension it's going to be when denied. After all the waiting, I hope to hear more experiences and sum good for you. I wish I am lucky too.
