I am thinking of filing green card for my sister and nephew. My nephew is 10 years old, will he age out by the time priority date is current? At what point in the immigration process does his age is locked? Anyone have knowledge about this?

Current wait times are about 13 years, so your nephew will age out.

Yes the age will be locked depending on the processing time and when PD becomes current.

For eg., if the PD is today and it becomes current when your nephew is 26 years old but i130 processing took 6 years, his age would be 26 - 6 = 20 years and he will be eligible.

Just expect i130 processing time takes lots of years for him to be eligible.
