hi i was staying in usa in B2 VISA from 13th jan 2015 to 15 june 2015 and came to denmark as i got visa of denmark. but tps has been approve on the day of my departure from usa. i have a question that do i be able to apply for TPS can i go back to usa and apply for the tps.? hoping of getting reply from you..

@admire You can still apply for TPS but you have to explain your departure from US. This is what I copied from USCIS website.

"To be eligible for TPS, you must:

Be a national of a country designated for TPS, or a person without nationality who last habitually resided in the designated country;
File during the open initial registration or re-registration period, or you meet the requirements for late initial filing during any extension of your country’s TPS designation (Late initial filers see ‘Filing Late’ section below);
Have been continuously physically present (CPP) in the United States since the effective date of the most recent designation date of your country; and
Have been continuously residing (CR) in the United States since the date specified for your country. (See your country’s TPS Web page to the left). The law allows an exception to the continuous physical presence and continuous residence requirements for brief, casual and innocent departures from the United States. When you apply or re-register for TPS, you must inform USCIS of all absences from the United States since the CPP and CR dates. USCIS will determine whether the exception applies in your case."

thank you so much for ur reply. i came here in denmark as i got 3 years permit of green card . but it won be renewed so. want to apply tps. giving the reason of permit of denmark would allow me to get tps . can you please suggest me

@ admire You will have to be here as soon as possible to be even able to apply for TPS. I do not believe you can apply from Denmark. You haven't said anything about your current VISA status for USA if you are able to come back or not. But even after that I would talk to a lawyer or someone more knowledgeable about immigration issues. I lack more information in that regards. But I can suggest one thing, if you give them PR for Denmark as a reason for leaving US I do not believe USCIS will accept that as an exception as they will see that as an option for you to go besides Nepal. Just my thought. I am not a lawyer so again I would still speak to lawyer or someone with better knowledge on immigration issues.

@luvraj. i have b1/b2 visa of usa till dec 2017 so i can come there to apply but i also doubt that USCIS will not accept the reason showing the pr of denmark grant me tps. should i ve to make ther reason. but i ve have 3 years visa of denmark not in passport but have 3 years resident permit in card.does thiswon allow to make other reason.i am humbly request you to ask abt my case with lawyer or the immigaration personnel. i heard i ve to enter usa within 90 dYS OF departure? is it? can you sugggest me?

@admire I am not in touch with any lawyers but one thing I know for sure is if you want to apply for TPS you might want to enter US as soon as possible and in your case speak to a lawyer before filing. Every case is different and its really upto USCIS to determine if you are eligible. I would also ask on other thread there is few guys who seem to have more knowledge regarding this than I do. If I get in touch with any lawyers I would be happy to ask that question.

@luvraj hoping of getting ur responses from other's viewpoint as i want to be confirmed as have to make decision. is this tps renewable?

@admire I understand your confusion and concern. If you get approved and if TPS gets extended for nepal yes it is. But thats unclear until they extend it for Nepal which won't be until december 2016. Try asking your question on this thread
