 Hello Friends,
How do we get birth certificate from Nepal for I-485. Please share your experiences. I was born outside of KTM but i made my passport and Nagarikta in KTM with my outside ktm address.

So, is it possible to make Birth Certificate from one of the ward office in Kathmandu ? will it work ?

I was thinking of typing in English in the English letter pad of Kathmandu Ward office...Plz let me know whether it will work or not..

Also, if you have sample of birth certificate, could you please share it. I think it will be useful to many of us..

Thanks.

Its better if you can make a birth certificate from the place your passport/ citizenship was granted...

Having said that, do not attepmt to make a fake one...cuz I am sure you're going for Interview shortly with NVC for your Change of Status
& they specifically ask & look at your Birth certificate....My suggestion would be:

Go to the place you were born ...either municapality or VDC in nepal & try to convince one of their representative about the requirements mentioning your relationship with your parents, because one of your parents ...either your mom or dad must be origionally from the place you were born n they will make one out for you

Once you get that certificate, in my case i got one in english.....nevertheless, go to Distict Development place & Notarize it....that way you gonna have both form in clear & concise manner !!!

Good Luck

Some key things about birth certificate for I485
1) If you had a birth certificate from hospital when you were born.. that's an ideal one.
2) Remember, you need your father's name as well as mother's name.
3) Your's passport/citizenship card does not have to match birth certificate (place of birth).
4) Try to get the birth certicate that shows you were born in that place. for example, your family lives in kathmandu but you were born in palpa; then you need a letter from palpa muncipality showing that you were born there not from kathmandu.
5) if they (palpa muncipality) wrote a letter in nepali; then you have to translate it in Kitabkhana; kathmandu.
6)if its written in english, you do not have to translate it.

Hi, I received RFE on I-485 process because i did not have my parents name on it. Therefore, i sent my brother to the municipality office to get a new birth certificate with my parents name on it. Since my brother took a birth certificate in English, i did not have worry about translation. On top of that, i also took affidavits from both of my parents. Below is the sample in case you need it and please do not forget to notarize the affidavits.

AFFIDAVIT OF (Dad's name)
(Dad's name), being duly sworn on (date), deposes and says that:
1. I am (number) years old and reside (current city)
2. I am the father of (your name)
3. (your name) was born in the city of (your place full address) on (your birth date)
4. (your name) is the son/daughter of Mrs.(your mother name), my wife

I declare under penalty of perjury under the laws of U.S, that the forgoing is true and correct

Finally, my gc approved.

Wish you luck

the best thing would be to get an affadavit from either one parent and one from parental uncle (usually kaka would be good as you would have the same last name). just needs to be notarized by a lawyer in nepal.

in addition to that you would need a non-avability certificate, saying that your birth record was not found when they checked the records.

i think this way is less hassale than getting birth certificate as USCIS these days send RFE for recently issued birth certificate(seen most cases but cant be 100% sure as they question how can you get a birth registered when you are adult.)

i did these things for my 485 last year.

good luck with your process.

For translation, in my experience, kitabkhana is unnecessary, just get it here and have some of your friend translate it and below, write that he knows bith english and Nepali well and sign in front of Notary here..

as far as i know , you dont need to notarize your birth certificate, have somebody type it in english using your vdc letter pad, but the person translating it has to mention he is fluent in english, to establish credibility, even if you want to translate it and notarize, the only place to do it in nepal(rastriya chapakhana) doesnt do it any more.
