its better if u drop ur status..if ur petition is disapproved by DHS then it goes to Court if u r out of status.or else u ll go back to F1 status if u dont drop ur status. and getting approval from DHS is 0.5 out of 10....most people who got approved are from court. so think bout it..

I think it is a bad idea to try from F1 status because your chances are much smaller when you come here in F1 and try for asylum. I know somebody who was deported and now is in australia. I talk to him once in a while on phone and he keep saying that he was supposed to transfer his school in california and supposed to do it from there. I think the approval rate is much higher in california. I am not very sure but you might wanna talk to people in california about this.

Apply from the state you're in ....because residency in important factor....Immigration is federal law and the immigration offices are just the processing centers of the federal government..If you move to other state and apply there your application will be frivolous and you will hard time proving your case is valid....if you have lived in a state for +1 year send your application to the nearest center possible....
application approval is much higher in California because of the higher application rate.....

They still can apply they have certain procedure for that....You won't be out of status tho if u are sent to court for first hearing ..Apply for Social Security and after certain time of that you can apply for Working permit too . First Hearing is formal they will mostly give you second hearing date which will be like 6months away or year away . Until then work and make some money or take classes.
