Hello. One of my closest friends just filed for his GC and he didn't file for his tax for a different state last year ( he only filed for tax for wages he earned in one state, he lived in 2 different states ). He wants to know if there's any interrelation between GC and Tax filing. In other words, will his GC application get denied for failing to file taxes?

Please help.

Check with GC: 212-947-1079.
The answer will be yes, you must file taxes. If you have filed incorrectly, must be corrected.

I'm aware of that, sir.

I just wish to know if my mistake will have any consequences though since its been over 3 months since I filed it. In other words, I was curious on Green Card Application's relation with tax violation.

And I'm going to rectify my error asap. Where do I go?

I am in a similar situation. My tax and pay stubs show my address to be in a different state and my application has a different state written on it. Well my lawyer did not flag it and my company would be at fault as well. So I just filed the way it was.

Yeah. I wanna find if it will have any effect on the GC though. Getting denied for failing to file for taxes will hurt big time!

I guess the Attorney would have foreseen it by now. As per my understanding the process runs something like this:


INS and IRS are two different organizations. As far as I know, INS needs to know, if you filed your taxes or not. However, how the taxes were filed is IRS jurisdiction, and INS has no say over it.  Having said that, if you had earned millions of dollars as earnings, and if your name was tagged within the INS system for some reason; then they could go back to IRS and ask for an audit. As you can see, this can happen only on a case by case basis.


Again, I could be totally wrong, therefore its best to check with your attorney...

hey guys, just go to irs website and file previous year's taxes with just a small late-payment fee (you could call it a fine) but that is the legal measure to rectify what you didn't know earlier or left it out on purpose.  then you can relax with a budwiser, i prefer pale ale! and if you were supposed to file taxes and should have been entitled to get back a few bucks, what you need to pay as a fine is just nominal stuff!
