H1 B Prblem Please Help...
I come to Nepal and did my H1B stmping from Nepal. My H1 B visa approved on October 2008. I got H1 B visa stampped on April 2009. The problem is I am out of project. I came Nepal on February 2009. I was out of project on December 2008. My dhoti consultancy employer ask me to stay in Nepal till they get me new project and told me I can't come US without project and US immrigation officer will return me from US port if I come there. Since I am here in Nepal, I didn't get any call from vendor/client. and everything seems not practicaland I feel i can't get US job from Nepal. i can't visit US in time if client wants face to face interview.If I come US without informing my employer, it is a risk. any suggestions ideas will be highly appreciated. thanks.
talk with ur company and try to convince them saying many of ur friends have left to US for work .
make some good stories and then see.

One of the sajha member suggest me to apply jobs in other companies through monster.com or cybercoders.com. If the company agreed to hire you then ask the dhoti employer for H1B transfer.

what is the procedure for tranfering H1 B visa? one of my friends told me we need recent paystubs for tranfering H1 b.
Yes, you Need at least 2-3 Paystubs from Your Previous Employer..Transfer of H1b is similar to Filing the New H1b Visa Except for the fact that if u have been previuosly counted against the CAP ,u won't be counted again for the CAP. These days Even transferring the H1B is risky. If u have a legit Employer who is willing to do theTransfer prob u will be fine. These days RFE are Killing people asking all sorts of documentation(Client letter,Job iternaries,W2 of other Employees who r working with u etc etc). So first thing Get a Job from a Legit Employer(Not Consultants). Then file for Transfer.

do these paystubs should be recent one? I came Nepal on January 2009. Is that ok I provide paystub of December 2008. will that be problem for transfering H1 b visa to other employer?
Yes, that will be ok if u provide Paystubs of December 2008. U need ur Most recent Paystubs.
The last three pay stubs is only required when you are in the US. While the beneficiary is abroad, the new company can file a H-1B Transfer for Consulate Processing without any pay stubs. Once approved, you can travel on the new H-1B Approval.
However, USCIS may issue a RFE asking for documents to establish that you had been maintaining your status while yo were in the US. Documents may include pay stubs for the period you were in the US and Tax Return/W-2.
