Hi Sajha Friends!

I came on H1b from Nepal. My three years has completed and I filed for extension but got denied.

I am in serious trouble. I don't know what to do now. I can not think of going back as the situation is really bad back home.

I am just wondering what my options are.

Please help!

Go Illigal, they will have to give you a GC in a few yrs. Or better, marry a US Citizen.

Do you know any college that accepts with out GRE and toefl ?

They didn't extend your visa...why?? this is the first time i have heard about it...if you don't mind can you please explain about it so that others can be aware about this issue...


I am not sure about the college accepting without GRE or toefl but i guess you can request a provisional admission and give your GRE score in few months time...good luck.

I believe this has to do with the current situation of economic downturn.  US Government is actively looking for ways to discourage/eliminate employment of foreign nationals because the unemployment rate is close to 9%.  Tough times.  But good news is, economy is making a turn around.  If you can hang on this year, 2010 should be much better.  Good luck!

Riten is absolutely right. Deniel may be due to bad economy.

Go back to the school. There are a lot of schools which may not ask

about GRE. But they may ask TOEFL.

Which area you are? Try to explore the friends in that area.

pranita1980 if you have been working in h1 and do have paystubb try to change to f1 status. If you have 2 recent paystubbs you have 80-90% chances of getting f1 visa. when your h1 extension got denied did u get notice to leave the country?


An alien already in the united states can apply for a change to f-1 status if he or she has maintained lawful non immigrant status up to the time application is filed.


Required documents/evidence


·        Form I-539


Application to extend or change nonimmigrant  status. The student should complete the entire form and sign it.


·        Form I-539 fee can be in the form of check or money order


·        Original I-20


-the student should submit an original form I-20 (the entire form). The student and DSO should sign the form where required.


- The sevis record should be created with I-20 issuance reason.” Initial attendance-change of status requested”


 


·        Proof of payment of the sevis I-901 fee


·        Form I-94 photocopy


·        Photocopy of current immigration status document, visa stamp, and passport id pages


At issue is whether or not the individual is in status at the time the change of status is being requested. Any immigration document (in addition to I-94) that may establish the validity of the applicant’s status at the time of application should be included. Copies of the passport id pages are included for completeness.


 


·        Photocopy of financial support documents.


Same financial support information used to obtain the I-20 from the school


 


·        Dependent family member documentation (if dependent family members currently in the U.S plan to change their status as well)


·        Letter from the student  explaining why he/she wants to change the status to f1 (its optional)

Try Maharishi University: for masters in comp sc/MBA its 8months oncampus course, rest of the 2 yrs course u can do it online while working full time under CPT . GRE not required, Toefl nice to have. www.mum.com/compro let me know if u need more info.

There must be reason behind H1-B extension getting denied. May due to some insufficient documets or something else. Please check in with your lawyer or the company for the reason why it was denied. They do not just deny because the economy is bad, in that case they should stop taking HI-B application this year. Also  there are blogs which tells you what to do when the H1-B extension is denied. Google it and get some idea about how to proceed.

I hope you don't need to change the status to F1, maybe you will be able to find some soluton. 
But in case F1 is the only solution, I suggest you to join any cheap community college, or Inistitutes which Issue i-20 very easily.
I heard an Institute at Chicago offers English course for 900 dollar per quarter and can help in changing status and issue i-20. It is Taylor Institue. I never enrolled there, I just heard from other...so you should find this out.

Finding college and getting I20s is not a big issue here. The real issues are the requirements of INS. To change status, INS needs docs mention by dipulata + it takes anywhere from 3 to 6 months (this is what i heard) + need up to date pay stubs + I20s from low tier college might create problem + etc. So more you delay more you are creating problem yourselves. So decide Now and Act Now.
