H1-B stamping in kathmandu ..... need help !!!!!!!

Hello friends,

I am thinking of going to Nepal for H1-B stamping, but I am little worried because my field of study is different than my H1-B category. I did undergraduate in Business management but my H1-B category is under "Programmer Analyst". I got my H1-B from Indian consultancy. If any of you have similar situation or experience please advice me.

Another Question, I do not have original copy of h1b approval notice. My employer has it. I read somewhere  that I need to take the original copy of my approval notice? What other stuff do i need to take. I have a list below:


 -Original H-1B approval notice and copy of documents filed with CIS, enclosed;
-           Ensure passport is valid for a minimum of 6 months beyond expiration date of notice.
-                                                                                   Current employment letter that states:  “Your name continues to be employed with us on the same terms and conditions as set out in the H-1B Petition we filed on his behalf.”
-                                                                                   Current pay stubs of employer;
-           Original I-94 card;
-           Proof of relationship of dependents applying for H-4 status (if any);
-           Evidence of maintenance of continuous lawful status in the US (transcripts, approval notices);
-           If you have ever been in J-1 or J-2 status, you must take with you all IAP-66 forms and, if applicable, a CIS wavier of the 2-year home residence requirement.
 

Any other docs?

I guess You need to submit I-94 (that comes with the H1B approval ) and the other white one you received at the time of arrival to the airport authority at the time of departure...


Is this correct....

Hey problems101.
You need the original I-797. I'm wondering why ur employer has it. I took lots of stuff(just incase), but just presented what was listed on US embassy at Nepal site.

-        Approval Notice Form I-797 issued by the USCIS

-        Evidence of Employment in the U.S. (e.g., Job letter, pay stubs etc)

-        Firm Registration Documents(I kept copy of my I-129 instead)

-        Tax documents, if any (w2s)

-        Prior visas/passports

-        Academic records i.e., transcripts

-        Any other relevant documents (i presented leave letter here)

-        Firm registration documents in the U.S. (for L-1) (didn't present this one)

-        Citizenship card


I'm working with a small company too, just few hundreds employees. My friends were working with similar companies, but not sure, why they got stuck. I just got reason  for one of my friend, which I posted earlier.

Yes, The I-94 that we get with H1B approval needs to be detached and given to Immigration officer while leaving USA.We need to apply visa with remaining h1-b approval notice.


Tech guy can you give more info on your friends who are stuck?

Thats what it said, but i didnt detach the I-94, and its still intact with my i-797.
Dont' know much abt other friends. Will find out and let u guys know.

The reason my employer is keeping the original is because it says "The petitioner should keep the upper portion of this notice. The lower portion should be given to worker"

My employer give it to me to put it in my document for visa stamping. I will return it back to them once I get stamped.

You actually don't need the whole page of I-797. Just the bottom detachable portion will work.

If you are going to Nepal. Do not forget to take both the bottom and the top part of your I - 797 originals.

I am planning to go by the end of february.My 2 friends just came back.One had his visa delayed by 3 weeks- administration issue and other gor rightaway.They both were from same company. I am from different company from them though.Please people if you have any experience or know what is happening let us know.

I got my stamping done in Ottawa Canada in June 08. Both the bottom and the top part originals are needed both in Nepal and anywhere else.

Questions asked in Ottawa.


1. What do you do for co XYZ?

I told her i was working for an IT consulting company. She asked me the project detail next. really wanted to know what project i was in.

2. How long have you been working for them?
 Gave time stamp
3. How long do you plan to work for them.
Told her no intentions to quit the job

4. Is this your first H1?
Little Trick question there....this was my second H1, i had let two employers file my H1s at the begining so she probably saw the record of it somewhere or could be just a fluke question

5. Can you show me the last few paychecks?

I said i have last 12 months paychechks, how many would you like to see" she said last 6..i showed her that

These were the official question. Counselor was really friendly and witty. She was holding a general conversation as well as the official questions to me in parallel.  She was talking about ANA convention, about my college, college towns, places i had been to and such.

Interview was about 10 minutes long. I was in at 8:30 am and was out by 9: 00 am.



Just remember to take all the documents that you need, they cant hold you back if you dont give them an opportunity for them to hold you back.

we get two approval I-797 and I-797 A


the later one has I-94 which has to be submitted to the airport along with the other I-94 (originally received at the time of entering US ) to airport authority before leaving US

Hey guys ........ do we get I-797 and I-797 A at the same time? I got my I -797 but not the I -797  A. Or does it come separately in different mail?

Guys I got I-797B instead of I-797A here in US. I dont know how this happened . I had requested a change of status from B1 to H1B . I work for a non-profit organization and they filed an H1 for me which got approved but it is I-797 B which i got. So do i have to go to Nepal now to file for H1 visa? My B1 has expired . So what status am i in now?............

Enjoy215, I am also in the same condition like yours. I got I797B while changing from OPT to H1B. You have two condition, either you can file Change of Status form again and receive I94 or You can go for Stamping. Since your B1 visa is already expired so I dont think you can do it by first way. So you have to go for Stamping. If you talk with any lawyer, let me know as well.
