Hi Friends,
My H1 is in process and hopefully I will get it sometime this month and I want to transfer to new company without working for sponsered company because this company is unable to provide me job and new company is willing to transfer. Is there any exception that I can transfer to new company now without running any payroll from sponsered comp. Any help suggestion will be very apreciated.
I don't think so U can transfer UR H1 with out any paystubs.
GOOD LUCK
Yeh, I think sbigyan is right. You must at least have 2 paystubs from the company that applied for your H1-B.
How does the transfer work? Hom much time will I have between 2 jobs. Can someone please shed some light.
The new company applies for you h1-b (same process but it does not count towards the cap). you can start working for the new company as soon as USCIS receives the application. You don't have to wait for the approval
Ok, I am definitely not a lawyer, but I do know that if our current company can't get you job and keep you on bench for a month then that is illegal under US law. So, you can definitely transfer your H1-B to another company. Check with some Lawyer forum and consult with good lawyer. It's about your future, do not gamble. Different people has different cases so we can't generalize. Good luck....
By the way, you said you will get ur H1 soon. Don't trust dhotis. They say one hing do one thing. Most H1's have started arriving and you should have yours by now. Take initiative and be proactive with these guys. You know there is a good saying in Nepal,"Marya dhotile jiudo Nepali dhagcha", that's very true in real life. Again, goodluck....
Thank you all, you guys are very informative and incouraging. My situation is that this Indian company put me on bench for long time I still don't have job and H1 on hand and I renewed my I-20 to keep my status stable. In this case, since dhoti is doing things that is against to law, can this be an exception that when I get my H1 I can just transfer to the company that is willing to give me job?
