My dhoti lawyer says: USCIS will not accept a birth certificate issued many years after the birth. Is that true? Can someone and experts like Santosh, Harrish,...................shed some light on that?

Get one from Nagarpalika. In most cases that works. In addition to that get an affidavit from your father/mother or some other relative mentioning that he/she knows that you were born in xxx place at xxx date. The combination of affidavit and letter from local government body works.

I do NOT think that would be a problem. I am sure afterall its a certification letter certifying that your relationship, your place of birth and date of birth. Atleast, people I have known never had any problems, who filed for GC with recently made birth certification.

If you dont have Birth Certificate, use the sample below to obtain affidavit from your uncles, brother or sisters. this is from the website for nepalembassy.com and this is what we use for our clients to submit to uscis Birth Certificate Embassy does not issue birth certificate. However, in case of hardship, applicants may apply for a certification letter with the following supporting documents as a proof of their date of birth: An application with parents' name, applicant's place of birth and date of birth; A Money Order or Cashier's Check of $ 25.00 drawn in the name of the Embassy of Nepal; Original Citizenship Certificate; Copies of Passport (page 1, 2 and 3); A copy of US visa; If the applicant is unable to submit a copy of Citizenship Certificate, submit a copy of any academic certificate issued by school or college with date of birth mentioned therein; and Postage paid self-addressed return envelope.

This is a crucial time for all of us who are in few days going to file AOS. Please make this very clear that USCIS will not accept your Birth Certificate issued by Embassy. kaliserviceusa: Thanks for sending me email. I appreciate it. I am still waiting for someone to reply to this thread if they want to work for free as I have been accused in recent post of trapping people and later asking for money. You guys live in free country, and no one is forcing you to pay. If you differ from the service, you can take it where it is convenient. Affidavit of birth certificate from Nepal is a great idea..but can anyone answer this question: Who can be considered the equivalent of a notary public in Nepal?

Third class officer or Higher in Nepal?? I am just guessing. But their commison do not expire like of Notary Public in US....

Does anyone have a format for "certificate of unavailability of birth records"? Also, does anyone know if Nepali govt officer's signature works in lieu of Notary Public for the purpose of Affidavit of Birth? Does anyone have any other idea (or has used any other ways in the past)? Any help will be really appreciated. DP
