I stayed in US for 5 yrs in H1 visa and am transferred to germany to different branch.Now after 1 and half years ,they r trying to take me back to US in L1 visa. My question now is: Will there be a problem in getting L1 visa as my H1 visa was supposed to be till july 2006.And I'm going there now in april.Do I need to be out of US for one year after date of H1 expires.Or just one year before or after H1 expires.My lawyer from my work says as long as I'm not in US for 1 year,they can start fresh.That one year gap doesn't apply since I'm already out of US for 1 and half year.What do u guys say? Which one is better premium or the regular one? Pls help me out for my peace of mind.

Germany, since when has sajha.com become the advising committe on immigration. you need to contact your own lawyer or call the INS

I would think that your stay at Germany for 1.5 yrs wouldn't count towards your H1B quota. Did you have to get a visa in Germany as well. I don't think it should be a problem. I would recommend $1000 premium processing, it's worth to have a peace of mind. Goodluck. M

after staying abroad for more than 1 year, you are not counted towards six-year limit. you can start fresh, good luck

Germany, Since you're out of this country for more than a year, you can start a fresh H1B which allows you to work for another 6 years. On top of that, you're coming back in L1, so you should have NO PROBLEM at all. Goodluck!

Sorry guys maybe I need to put like this.In this half and 1 year when I'm working in germany,I've been to US 9 times in B1/B2 visa due to official work.It used to be short trip like for 2,3 days and my lawyer has deducted those days too.In total it comes around like 30 days.My lawyer .is not worried on that.But I am now since I was in US on and off for 30 days altogether.So am I safe?
