I have a friend who is trying to go back home..
He finish undergrad , and instead of joining masters..he took some class of undragrad..on community college. Now he transfer to grad school..now he is planning to go back home..He is wondering if its a good idea to go back home right now ..He doesnt have a visa..(already expired) any body had such experience..What are the chances he will be denied..do you guys think they might reject in the port of entry..

Regarding your uncanny, I think your friend can join a grad school after he passes his undergrad. Once he does that the grad school will issue an I_20 by which he can continue. But remember that as far as it is known he has to join his grad studies within one month of undergrad results. If he does not he may be in trouble.

Ya he already graduate from Undergrad...
after OPT ..he went back again to undergrad to be in status.
Than after one year he admit to grad school...i hope u got it what i mean..

yeah i finished undergrad and went to Nepal and came back for Masters.
i spent 4 months in nepal and had to apply for new F1 visa. it was a success. i guess it all depends on your college grades and your criminal history mostly.
also in nepal u should be ready to show ur bank statements and family and asset ties to nepal.

After completing undergrad got the OPT. What did he do during the OPT? Okay lets assume he worked and joined the same college with or without updating his visa status?My question is did he got I-20 again and did the community college process for f-1 status change?
Before answering, must know these things first. NiceDude you have to be more clear on these questions. The answer would be appropirate knowing these facts.
1) Just going school does not mean your visa status is maintained.
2) Once the OPT date expires , may be 1 months or 90 days , I am leaning towards 90 days to be in status.
3) Depending upon the internationl school advisor (the current immigration attitudes) they may proceed for visa status change. But it is upto Vermont's office.

If he is in status of F-1 and attending college , in that case he is in status and shuold be problem.
But.
They might ask question why community college and why undergraduate college after graduating? Your friend should be able to answer all possible question that will satisfy to vissa issuer. So visualise all possible questions and find the right answer but his answer must be consitant and corroborating with privious answer. They ask question like a lawyer. I hple he will be fine. Couple of my friends got admission in next level program and camet back to Nepal with new I-20. Think of different options and adopt the best that you think.

a better idea for your friend would be to enroll in masters and then goto nepal after 1 semester or after 2 semesters of studying in grad school... that way when he goes back to nepal, they dont want to stop his studies in the middle also. he has better chance of approval.. as long as he has been in status in usa all the time.
