Hi everyone,

I am in a pickle. After doing a lot research, I submitted for my TPS EAD and I got rejection notice saying "the eligibility code you provided on your I765 requires proof that an I-821 has been submitted. Please resubmit your Form I765 with a copy of your Form I-821 receipt notice.
Please be sure to complete the application fully, submit the appropriate fees, and include all the required supporting documentation. "

I did submit my TPS approval valid from 6/25/2018 to 6/24/2019. I thought we don't have to submit for I-821 and this one got automatically extended. I sent $410. Was I also supposed to send I-821 form with the fee?

This time you should include a cover letter stating that you have a valid TPS status as per the federal register, additionally mention the court case mentioned on the TPS page for Nepal and would like an ead.

Mention the reason behind not having ead during the last period to be opt and include that EAD.

Add copy of the usicis request that said reapply. Hopefully they accept this time.

If your EAD has expired in jun 24 2018 and you still have that, it is also extended till Match 2020 automatically. All you need to show your employer for work is the expired EAD and the federal notice from

@maxpayne, it's a little to late to do that because I already sent it back. I added 85$ and filled out that i821 form for re-registration because I didn't want to take a chance. There was nothing else I could do and I didn't have this kind of useful suggestion at that time. I did include the reapply paper.
I didn't know I could write a cover letter and print it out and include it with the package. :(

@chelsa yes adhikaar told me the same, that we can submit the same package. But some people got rejected twice. I don't understand how they can do it twice and later they claim it to be right and their fault. It's already late for me, If I don't receive it soon, I will lose my job. They kept it for a month and sent it back.

Unity for what's it's worth, do a check on everify for yourself, that option is available on the USCIS site.
All valid ead come up as green eligible to work. That way you can get some time from your employer. Employers are also supposed to check validity there and not just rely on the printed dates on the card.

@maxpayne thank you for that information. It looks like I have to create an account first. I have never done this before. I heard once we get a new EAD the old one gets terminated because one can't have two valid EADs at the same time. It makes me think if my last TPS EAD which expired in June 2018 and Oct 2018, I got my OPT, what happens to that TPS EAD? I will be checking for those two EADs on the everify page.

I tried to check but I could only check my OPT because it's still valid but it doesn't allow to pick 2018 or last month and year. Is there any other way? otherwise I won't be able to check my eligibility for 2018 TPS EAD

Not sure if you looked at the image and the link i posted above, but fyi, copying the contents again.

The uscis is itself saying all you need to show your employer is your expired EAD and the federal notice that mentions it is autoautorized to work till March 2020. Not sure what you are still looking for.

USCIS is automatically extending through March 24, 2020, the validity of EADs with the category codes “A-12” or “C-19” and one of the expiration dates shown below that we issued under the TPS designation for Nepal to individuals who continue to maintain TPS eligibility:

Beneficiaries under the TPS designation for Nepal who applied for a new EAD but have not yet received their new EADs are also covered by this automatic extension, provided that the EAD contains one of the expiration dates noted in the chart above and their latest EAD application has not been denied. Such individuals may show their EAD and the May 10, 2019 Federal Register Notice to employers to demonstrate that they continue to have employment authorization and that USCIS has extended their EAD through March 24, 2020.

Unity it is illegal for your employer to fire you when your ead is extended by uscis. They can get sued for lots of money. Make sure you show the letter from federal registry and your prev ead. Take an info pass or talk to your Congress man/ woman. Talk to justice dept look for 1800 ph number and ask them to call your employer if your employer dont believe the auto extension letter. If you have the right to work dont let that get taken away just because someone is not informed.

@ark and ehho2 thank you for the info. I was trying verify because you know how much hassle it can be without concrete evidence or having a clear picture, we have to bear consequences. I just have one question, in my situation where I have always been approved for TPS since the beginning and the last one got automatically extended. I had applied for TPS EAD first and second time but the third time I didn't, I just applied for TPS because I applied for OPT instead. Therefore, my last TPS EAD was valid from 2017 to 06/24/2018 and then I applied for OPT. I had heard once you apply for a new EAD then the old one automatically gets terminated, did my OPT do that to TPS EAD? In this situation, do you still say my TPS EAD is valid, it doesn't get terminated because I applied for a new OPT EAD?

I know I am asking a lot of questions but I have to. I need to give you guys a clear picture because every situation could change an opinion. Thank you for understanding and please let me know.

I am very curious about one thing: if it is valid, the ones which expired in 2018, 2019 then why people are applying for the EAD card? Please help me to understand.
And please answer my previous posts regarding having 2 work authorizations and how does it work in my case. If one terminates the other?

Your question needs serious answer I would post it on avvo.com or immigration portal.com even get a half hour free time and go talk to a lawyer ,its worth it. Get multiple opinions tho. Good luck

Avvo.com is free ,immigrationportal.com is free ,most lawyers have first half hour free ,even if you have to pay it may cost you a hundred dollars or so it's cheaper than sending what its gonna cost u otherwise

TPS EAD and OPT are independent things so issue of one does not cancel the other. For ex , issuance of new OPT EAD will cancel previously issued OPT EAD. Issuance of new TPS EAD will cancel previously issued TPS EAD. But your OPT card has no effect on previous TPS EAD.

@UNITYISPOSSIBLE : Did you get any updates for TPS EAD?

I did apply same as you (file 821 and $85 check in addition to EAD application) . I got receipt on Sept 5 that says we received your application and deduct money from my bank. Still the status is same.

My current STEM OPT is expiring on Oct 19. I am kind of worried that I will loose my job because of work authorization problem.

No, they do not do that. It's a public organization. I was told by HR, I will be in leave without payment. The downside for this will be I will not get pay but I need to pay full cost for medical insurance and other benefits.
