So can a TPS folk apply for adjustment of status if has been out of status (for less than a year more than 6 months) before TPS thru employment based given the time frame of new EAD extension  and below injunction as well?

@maxpayne

What if the court case ends before March 24 2020?
Lets say the could decided in favor of government on Sep 2019. Will it still be valid until March 2020 +180 days? or Sep 2019+180 days?

Is there any possibility of the court case ending so soon? Any appellate courts where the decision could be appealed?
Thank you

In Case of Reversal
If the court reverses the preliminary injunction and that decision is final, the terminations of the TPS designations for these four countries may take effect, unless the final court order places other limitations on the terminations. If one or more of the termination decisions can take effect, DHS will allow for an orderly transition period of at least 120 days from the final ruling lifting the injunction regarding the affected TPS country or countries before implementing and enforcing the TPS termination determinations. During the transition period, current TPS beneficiaries who do not have another lawful immigration status or authorization to remain in the United States must leave the United States, or they will be subject to removal.

It depends on the courts. Im pretty sure ACLU will go to higher courts if the decision is against TPS. On Oct. 11, the government appealed the injunction to the Ninth Circuit Court of Appeals. A briefing schedule has been set with the government’s opening brief due Nov. 8 and the plaintiffs’ reply brief due Dec. 6. Until Jan no decisions will be made.

Bhattarai v Neilson case is filed at northern district of California and the case is looked after by Obama appointee, Judge Edward M Chen.Therefore, I'm 100% positive that the case will be ruled out against this administration, in our favor. This case presumably will extend to as many as couple of years and if Biden is elected the next President in 2020 election before the final termination.....Guess what??????????? Drop your thoughts!!
