On Oct 10th, USCIS put a new rule regarding public charge for GC seeker and GC holder. It doesn't clearly telling us whether or not it excludes ACA tax credit for low income family. Can anyone put a light one it?

Q. What publicly funded benefits may not be considered for public charge purposes?
Non-cash or special-purpose cash benefits are generally supplemental in nature and do not make a person primarily dependent on the government for subsistence. Therefore, past, current, or future receipt of these benefits do not impact a public charge determination. Non-cash or special purpose cash benefits that are not considered for public charge purposes include:


Medicaid and other health insurance and health services (including public assistance for immunizations and for testing and treatment of symptoms of communicable diseases; use of health clinics, short-term rehabilitation services, and emergency medical services) other than support for long-term institutional c

This is just a proposed rule that was posted on federal register on 10/10 for public comments. DHS has to go thru those comment, tackle lawsuits (which is very likely) and then draft a final rule. SNAP, CHIP, medicaid, housing benefits etc are mentioned in proposed rule that will count as a public charge.
People who are currently using them shouldn't worry about it at all , at least for now coz the rule clearly says it won't affect individuals who used it before the effective date of the final rule. Once it's final, you can think abt it. Coz the final rule will have lots of things changed. So don't panic for now. Also, it's gonna take abt 5 more months for the rule to be finalized.
