My PERM took about 3 months as well. Approved in June.
I recently (late August) filed for I-140 and 485 and concurrently. I am not aware of any such quota though.
My suggestion is to apply I-140 in premium processing. Mine got approved in 10 cal days.

sm5275, congratulations on your 140 approval!!

I am also filing 140 as premium. But lawyer ne nai bhanya September ko sakiyo rey. October maa matra file garna milcha rey aba 485 chai.

Did you file for an EAD with your 485 application? I don't know what your status is. I am on TPS and since my current EAD expires in June next year, it would make more sense if we filed for an EAD along with 485 as well.

@StatusPidit, Thank you, and good luck to you as well.
Yes, both EAD and Travel Document. I am on H1 but my wife is on TPS. So, she is in a similar situation as yours.

does anyone know how long its usually taking for regular i40 filed these days? I see USCIS shows 3.5 - 6 for TSC and 5 - 7 months for NSC.

@bakakallu

I-140 is filed by employer based on the approved PERM so you don't need to submit any documents except you have to sign the original PERM. Whatever documents was required for I-140 you might have submitted at the time of PERM filing.

I-485 has a few document requirements. You can check Instructions for Application to Register Permanent Residence or Adjust Status or following links: -

@bakakallu, hope this helps.

I-140
  • Passport - bio and signature pages
  • All degree/diploma, transkripts
  • Experience letter from your past employers
  • Current and previous U.S Visa
  • Recent I-94
  • All current and previous immigration paperwork(I-20, I-797 approval notices, EADs)

I-485
  • Birth Certificate - from Nepal(a standard letter from VDC/Municipality stating the date, place and parents)
  • Proof of Marriage (if applicable)
  • All pages of your current and any previous Passport.
  • All immigration docs - same as I-140
  • Medical Exam - I-693
  • Photographs - 6 PP photos if you apply for both EAD and TD

If recently married(less than 2 years), additional docs
  • Joint utility bills, phone bills, credit card statements
  • Joint bank statements
  • Joint tax returns
  • Joint lease agreements
  • Marriage photographs
  • Affidavits from friends/family testifying details about how you met/marriage ceremony

You'll also need 5 years of your employment(US and Nepal) and residence history.
Also addresses from Nepal if you have lived in multiple locations

Note: these are the docs I needed. But, it will depend on your lawyer too. I recommend you get a list from them for each form.

Hello sm5275 brother,

Thanks a lot for that detailed info. For birth certificate, how did you do? Also, did you have to translate it into English and get it attested from a lawyer in Nepal? I need to order one as well, since I don't have it handy.

Thanks!

To add for birth certificate,
Nowadays birth certificate is provided in both Nepali and English by wada. If not then one has to go to kitab Khana, babahar Mahal for translation and attestation.

Also you need affadivit of support from parents( Father & Mother) to support your birth certificate.

And S.L.C character leaving certificate which has English D.O.B

You're welcome! Happy to help, Bro.
It's just a letter from your municipality/VDC in Nepal. You'll have to have someone get it for you from your birthplace and mail it to you here. You can have them draft the letter in English. Not required to attest it.

Please DM me if you need more details. :)

@bakakalu Congrats for getting ur GC and thanks for sharing some valuable information...

I am also planning to file my I-140/1485 once my PERM gets approved. So, is true that the I-485 processing timeline varies by the USCIS service center (or your current location i.e. city/state) that you filed? Also,I noticed that the timeline for scheduled interview was different for various applicants. Is it solely based on location?
Please share your input. Thanks...

@looper. Thank you.
Yes, it true that processing time will varies from state/city as well as immigration officer and and backlogs/retrogression. My interview is totally different than other location, if you look at the timeline for my case my fingerprint was done after the interview. Make sure you review the I485 form before filling. Good Luck.
