Maintaining F1 status before H1B starts
Hello All,
My H1B got approved for 3 years and the start date is October 1, 2018. I am working on TPS EAD and my underlying immigration status is F1 as well. I have filed TPS registration and TPS EAD as well. Do I need to maintain F1 status till October 1? What happens if I do not take course on fall?
Brother, first of all, congratulations on your H-1B success. That's a very interesting situation you just asked about. Since you are not going out of country for stamping (because you had filed H-1B as COS), I'm not sure if you don't take classes for Fall, what's gonna happen to your status until October 1. I think, to be safe, you should enroll, just for the heck of it. But, please consult an attorney.
Good luck, brother!! :)
when does your F1 status expire? You should be covered with CAP GAP rule. please research.
But I do not think you need that since you have TPS also.
@STUPIDA
I am not in OPT. I am just full time F1 student working with TPS based EAD.
@StatusPidit
I got the receipt from the lawyer with 3 years of H1B. I hope you will hear good news soon too.
Then I guess register for classes and drop it for partial refund if you do not want to take chances. OR register for those classes only which are fast track but starts after October or towards 2nd period of semester. Then drop all those. You should get full refunds.
But still being on TPS/EAD should cover it. But do not just rely on my info.
Many Congratulations Nepali Najar bro on H1B approval....how many credits did you take while maintaing F1 and using TPS EAD ?
3 credits as I am grad student.
