Hi guys,

I don't need TPS work permit because I will be graduating in 2 months. Therefore, I am planning to apply OPT. Anyway, we have till December to get a new work permit. Do I still need to fill out I-765 with my I-821? I will be applying for TPS though.

Please let me know. Any suggestions?

No, if you do not want EAD through TPS, you do not have to file form I-765.

If you read the instruction PDF for I-821, on page 13, it clearly says "If you are not requesting employment authorization, you do not need to file Form I-765."

If you want to use your work permit from TPS till December then you have to fill up form for EAD too.

Oh, I wanted to use it till October and use my OPT afterwards. Does that mean if I only apply for TPS it will automatically expire but when? I am confused please let me know

Suren isn't correct. The existing ead was auto extended until December. If you have ead now you can work until then.
I hope you have notified your DSO with your intentions, just to make sure you're not missing anything from F1 perspective.

What do you mean? We can use TPS EAD and maintain F-1 status right? But need to inform the school ?

@advice_7 . I have applied OPT last month. Depending on my decision by USCIS, u can plan accordingly. I am hoping it wont get rejected

@advice_7: only if you get approved a hardship waiver. In short, according to USCIS, no you cannot "use" TPS EAD and maintain F-1. However, You can "possess" the EAD and maintain F-1, just can't use it. Ask your DSO about the policy without inferring that you have used it (if you have already used it).

@ ajoshinp did you use TPS EAD or are you using it before applying for OPT? if anybody else did or they are on the same boat, how did they handle? please let me know. This is very stressful.

How many people are in TPS? Marriage each other if any girls are in TPS. Helping each other will be good idea.
