i think some consular take these issues seriously, my vina few years back had problem reentering usa, he put an issue that he took more than long to clear his graduate degree and asked y he transfered from uni to community clg n so on( i think his concern was his primary purpose was not education) .. he was denied that time some how after one year he got visa,,now he has gc. 11 years is a long way, im wondering how u passed these years without seeing families, anyways good luck..though i have no idea still i suggest to take extra caution if u have visa sponsored by IT consultancies...

Everyday talk with family starts to fade once you live more than a decade in US. The only responsibility I see is with core family grand, mum, dad & siblings. People have changed in Nepal. Once you visit there, you will find out. Its just our mind saying we have to visit after a decade because Sahara Koirala would go there every year and she might nudge you, why you are able to stay here for 11 straight years ? Your home is where you live and your happiness is inside you. Now your priority is to work on H1B and have some experience and money. Didn't you wait so long to have H1 ?

If you waited for 11 years, do not take risk unless it is emergency. Get your gc filed, Nepal is current. File your 140 and 485 concurrent and apply for advance parole. If employer starts your processing in a month and is willing to help you , in around a year, you will have advance parole and you can travel safely. If employer starts processing this month and tries to slow down as much as possible but actually file your application , you still have your travel doc in around 1 n half years.

USA dream is such that the very incompetent people are by design given all the privileges that they can get...while the most competent people are chained forever...Happens for all races...from Jews to Chinese...those who get DV are worthless in Nepal but here they come and become citizen very quickly..while the 4.0 ....always getting A in schools wait for decades to have their visa things fixed...what a game that's played...by those who can..

I got my H1 last year and got it stamped from Nepal quite easily. H1B is a dual-intent visa so it should not be a problem. But IM me if you want more details.

Yes i feel the same when i look back, how did i stayed here for 11 years without visiting family even once. Life has not been easy here and thing never went as i thought or planned. So mine is same story as most of US students have that you might have already heard. But now i am trying to avoid it to be 12 years and stop answering everyone in Nepal on why i have not been back yet.

Yes H1B was the dream when i was in college and always told myself and parents that i will visit Nepal once i get H1. So now that i got it i am scared to go back thinking may be I won't be able to come back to US.

Thank you all for your input. I am in same debate, why to take risk now after 11 year and why not just wait for couple of more years and get green card and then go.
I guess it is just individual luck. No one can guarantee the outcome and i will not know until i experience it.

@unluckySir - I just noticed the message and replied.

Dual Intent Visa - they won't question you about your intention to stay in the US in H1B like they did in F1. It is one of the only visas in a handful, where you can get processing for GC while under the visa. so , you should know by now, in H1B, we are considered resident and we even qualify for resident tuition in colleges in the State (if not, there you go - bonus).

There are other advantages in it as well but that's the most important one I know.

I have same feeling like you bro.There is no definitive answer when you should visit Nepal. 11 years does not define overstay or under-stay. They do know that its not an easy thing to come to different country and finish the program. People do take time to finish the program. Many people do change the Major while in school and the reason to choose community college is definitely money. It's not that they don't know. They do have a fact data sheet saying how long does it take to graduate and begin our life in USA. One of friend recently went on h-1b Visa and she made to USA completely fine. She didn't have any issue and nothing was asked. I don't know she was lucky or same is the case with others.

I know couple of my friends are in same boat and they also want to go NEPAL because its not easy that all Employers are willing to sponsor you green card. I know some of my friends employer are delaying for current administration and some employer are not willing to do.

But we need to live a life and move ahead and do all the things. What I have heard from two friend so far is that it wouldn't be problem. Just check the date before you leave the country so that you don't have to wait in waitlist to get H-1b stamp.

Thank you bro for your input. Most of us students share same story, going through lots of pain to get to this position (I mean H1) and then suffering from these employers. Glad to hear most of us are making it back easily from Nepal on H1.
I will also take my chance and travel back to Nepal. I will stay positive and hope for the best.

I did mine in Canada. It didn't take 11 years but took more than enough. But don't go to Toronto or Vancouver. I did mine thru Calgary. It was too easy.
