Hey gyus,
I got RFE on I-485 on Birth Certificate.I had submitted my certificate of birth registration from VDC but the birth registration date was 2013.Now they said " your registration was not at the time of birth",they asking for secondary evidence. Anybody had this situation? I need a serious help here to solve this situation.What will the best secondary evidence and affidavits to submit?

Provide two signed affidavits (notarized will be even better) one each from mom n dad mentioning the details about your birth like name, place, date etc. google for affidavit of birth and you will find tons of sample.
While those two affidavits are enough, if there are any documents that list your birthday and parents name, provide a copy of that too.

mero lawyer le Traditional Birth Attendant (TBA) ko affidavit ra school record pani khoji ra cha. Tyo TBA kaha bata lyaunu aba. thyo ki thiyena tyo pani tha chaina.SLC ko charecter certificate ma DOB ,home address ra father's name ra cha.Tara DOB nepali calender anusrar cha.do you think that will be good idea to provide that school record too?Lawyer was telling me we have to show them how to convert it on AD.I guess i have to request school to new one.Has anybody submitted TBA's affidavit?

Translate SLC certificate in english and put nepali (and english in bracket). You can also put a BS to AD date conversion website screenshot. Also see if you have older certificates like 5th grade, 8th grade district exam certificate with DOB. TBA bhaneko susare or home birth ho, I think. So, ask someone who has knowledge of your birth or who was present at that time to give affidavit. This worked in my sister's case.

I went through same exact process while I did i-130 for my parents 6 months ago. I did 2 affidavit, a letter from my school & a cover letter explaining why birth registration was done after I turned 21. It worked.

Registration Criteria: Birth registration certificates are issued at the request of the concerned person or the concerned person's family. Despite the legal requirement, very few parents register the birth of their children at the time of their children’s birth. Birth registration certificates are often issued long after an individual’s actual birth. Birth records issued by hospitals are not considered legal documents, but can be used to obtain a legal birth certificate.

Send that above text and link to USCIS and write a cover letter mentioning.

I) Nepal custom doesn't mandate that we register the birth of our children when they are born. It can be registered late by paying a small penalty. This is the reason why Mr. Xxxxx's birth was registered late.

2) provide affidavit of birth from your Mom and Dad and from someone who has seen your birth. Sign it, notarized copy.

3) contact your primary school , ask them if they can provide old school records where your date of birth is listed. Or if you already have a old school mark sheet, certificates that's great. If no record is found, ask your school to write a letter describing your date of birth was xxxxx and was born xxxxx , show both parents name as well.

That should be more than enough.


FYI, I had received RFE as well and I did the above things and it worked like a charm!

I have the exact scenario, where I have sent a birth certificate that was requested back in 2014 (Received date: Nov 16,2016). So do all I485 cases with late registered birth certificates get RFEs? Or it really depends on the processing officer? Can folks who have been through this issue advise whether it would be wise to start working on these documents now, just in case an RFE is issued? or wait until the RFE is issued?

This whole thing is making be very restless..please advise. May the original poster of this thread get this resolve and get his GC soon!! Good luck!!

@Zeepa, yo processing officer ma depend garcha jasto cha.same case ma maile chineko ko recently khi namagi approve garyo.
