काठमाडौँ : मुलुकी ऐनको प्रतिस्थापनका लागि ल्याउन लागिएको देवानी कानुनमा पत्नीले स्वेच्छाले सम्बन्ध विच्छेद गर्दा सम्पत्ति नपाउने व्यवस्था प्रस्ताव गरिएको छ।

देवानी कानूनको संशोधन तथा एकीकरण गर्न बनेको विधेयक परिमार्जनका लागि गठित उपसमितिले अब 'पति सम्बन्ध विच्छेदको कारक नभए' सम्पति दिनु नपर्ने प्रावधान प्रस्ताव गरेको हो।

मुलुकी ऐनमा पति र पत्नी छुट्टिदाँ सम्पति आधा-आधा हुने व्यवस्था छ। उपसमितिले प्रस्ताव गरेको व्यवस्था विधायन समिति हुँदै संसदबाट पारित भएर राष्ट्रपतिले प्रमाणिकरण गरेपछि लागू हुनेछ।

उपसमितिका सभापति राधेश्याम अधिकारीले नयाँ व्यवस्था प्रस्ताव गरिएको जानकारी दिए। मंगलबार उपसमितिले आफ्नो प्रतिवेदन समितिलाई बुझाएको छ। 'पुरुषका कारणले सम्बन्ध विच्छेद भएको प्रमाणित गर्न सक्नुपर्छ, कारण केही छैन भने दावी गर्दैमा अब सम्पति पाइँदैन', उनले नयाँ गरिएको व्यवस्थाबारे खुलाउँदै भने।

त्यस्तै उपसमितिले अब सम्बन्ध विच्छेदका लागि पतिले पनि अदालतमा मुद्दा दायर गर्न सक्ने प्रावधान प्रस्ताव गरेको छ। यसअघि पत्नीले चाहेमा मात्र सिधै अदालतमा मुद्दा दायर गर्न पाउँथिन्। पतिले भने गाविस वा नगरपालिका कार्यालयबाट मुचुल्का उठाएर जिल्ला प्रशासन कार्यालय हुँदै अदालत आउनुपर्ने प्रावधान थियो।

उपसमितिले अब पति र पत्नी दुवै अदालत जान सक्ने तर मुद्दा दायर पछि एक वर्षलाई सम्बन्ध सुधार वा समझदारीका लागि कुलिङ पिरियड मान्ने व्यवस्था गरिएको अधिकारीले बताए। 'अर्थात् सम्बन्ध विच्छेदको मुद्दा दायर गरेको एक वर्षपछि मात्र कारवाही अगाडि बढ्छ', उनले भने।

संसदमा २०७२ सालमा पेश भएको मुलुकी ऐन प्रतिस्थापनका लागि ल्याइएका विधेयकहरु माथि उपसमितिले ११ महिनामा १ सय ६८ घण्टा खास छलफल गरेको उनले बताए। उपसमितिले तयार गरेको ८५ पेजको प्रतिवेदनमा कयौँ नयाँ कानुनी प्रावधान गरिएको समेत उनले बताए।

'प्राइभेट इन्टरनेशनल कानुन पनि बनाएका छौँ, गुठी सम्बन्धि प्रावधानहरुमा परिवर्तन गरेका छौँ' उनले भने।

विधायन समिति सभापति गंगा चौधरीले आगामी बैठकमा प्रतिवेदन पेश गर्ने जानकारी दिइन्।

There has already been many misuses of the default property right for women upon divorce. So now if a woman wants a divorce then she better have a good reason and not be a classic gold-digger.

They need freaking fix the shit that woman don't get to claim property of husbands parents ...they need to realize that marriage is between men and women not between their parents ...until they fix the crap there will be abuse all the time.

They also need to fix the law that child can sue parents for property, it should be will based. Looking at these outdated Laws i really feel bad and how stupid can our fellow neplease be , to take this long to fix these social disease .

now on wise man will never divorce his wife and keep on fooling around the mistresses for life not worrying wife taking his half, a lottery fo him , double torture for women - talk about side effects of solving everything from only one viewpoint. Judges and law makers the stupid creatures in nepal HAHA

There are more male victim in Nepal compared to female because of foreign employment. They work their ass off in desert heat and when they come back home their wives are ready to roll with other guy with half (they take all the hard cash) of the property. This has been a major social problem in Nepal and needed to be taken care of. Also, I don't think this is one sided solution. Women are still given half the property if they have been wronged.

Both men and women should be able get divorce easily, if they think they can't live together . What the heck is one year of cooling period , couple of month is understandable.

When it comes to property only the stuff they earned during tenure of married , with joint house hold effort should be claimable. They get to claim property of don't know, dad mom uncle aunt every one . What kind of stupid law they are.

If men cheats let women cheat, make domestic violence criminal case , and let divorce be civil case. And make property transfer based on will. These fix will take off half of court case over the time . Nepal is way over due for this fix . And this is definitely dragger for social advancement

हुन गईरहेको कानूनी ब्यबस्थाले पत्नी पिडितहरु लाई राहत मिल्ने मात्र नभै बैबाहिक सम्बन्ध लाई ब्यबसाय बनाउदै बिवाह गरी सम्पत्ती लिई सम्बन्ध बिच्छेद गर्ने र पुन अर्को बिवाह रच्ने बद्नियतधारीहरु लाई समेत हतोत्साहित पार्नेछ । कानूनी ब्यबस्था लाई सकारात्मामक मान्नुपर्छ ।
