I am an F1 student graduating next month/ December in STEM program (MSCIS). I am currently working in TPS EAD and reregistered to renew EAD and TPS. I am not sure whether I should I apply for OPT or not after I graduate. If I just leave my F1 and continue working in TPS, how easy to get back to F1 after TPS over? Will I be able to use my OPT after TPS over or not? If any one in the same situation or have any Idea, I would appreciate your response.
Thansk
I graduated on around July Last year (quarter system school). TPS was approved for Nepal around same time. I did not apply for OPT and got EAD from TPS. I am a full time employee now and have no issues with it. I did notify school about my change of status to TPS and my F1 status is on hold now.
@chinday: i would be happy to know the process for how to make OPT on hold?
How you know that you are on hold?
as you graduated and used TPS EAD for your work authorisation did not you violate the F1 status (see link http://myattorneyusa.com/storage/upload/files/etc/uscis-faq-statelessness-and-the-ability-to-work-for-joint-f-1-tps.pdf) . may be you have different thought on this.
As per my understanding on your comment: you can still go to OPT if TPS ends(whenever it will end June 2018 or further ) is that correct? did you have any link that says you can put OPT on hold? please share I am eager to know
Thanks for your time and information.
Well my understand in if you are on campus and taking mininum credits, you can remain in F1 status on HOLD and get TPS with EAD benefits. However, if you have already completed your college credit course and in OPT, using TPS with EAD will terminate OPT for sure. If you want to come back to F1, you have re-instate your F1 status by applying again.
So do not just guess, consult with lawyer, college intl advisor and talk with USCIS. This is such a grey area and you have to be careful not to mess with OPT. As long as you are in OPT, never use TPS EAD.
