I know it has been discussed several times about late TPS application. However, I am still Confused. I meet all criteria on TPS. However, I was in F-1 visa (nonimmigrant visa) and I did not file TPS when it was opened ( I dont know why I did not apply that time?). Now since it is extended can I apply now? Now I am in OPT. Can you please clarify. Thank you
There are late filing criteria clearly defined by USCIS. If you fall under on of those criteria, you can file TPS.
You were a nonimmigrant, were granted voluntary departure status, or any relief from removal;
You had an application for change of status, adjustment of status, asylum, voluntary departure, or any relief from removal which was pending or subject to further review or appeal;
You were a parolee or had a pending request for re-parole;
You were a spouse of an individual eligible for TPS or you are still the spouse of that person who is currently eligible for TPS; or
You were and remain a child of an individual eligible for TPS.
Thanks cybro. I have seen that. However, I am not sure if I fall in one of them. That is what I wanted to confirm. there might be many F1 student who did not file for the first time. Any idea?
As far as i can tell from information you provided, you do not fall in any of those criteria.
