Guys, I am going to Nepal for H1b restamping, my TPS is still pending. My Employer has filed for PERM as well. What would happen to my TPS application? Would i have any issue getting my H1b restamped in Nepal because i had a TPS application pending?

ideas?

Anyways, I see you have been waiting for a reply bro. Your thread from earlier last week titled "Travelling to Nepal_need H1B/H4 Re-stamping" also didn't get any response. I'm sorry bro. Maybe none of us were in that situation or none of us had the answer to your questions. I know how it feels to not get a response even though the view count is high.

I hope someone would gracefully pitch in with their suggestions. Good luck bro!!!

TPS is backup and has nothing to do with h1b stamping...moreover you are not doing cos from TPS to h1b...I don't think your TPS will be impacted but during re registration ( if extended) of TPS they may issue RFE asking why you were out of country as one of the general req of TPS is continuous stay in US.. Call USCIS .. There is an option which you direct you to people who can answer TPS related questions ....

Anyway....I am not a lawyer but i will answer to the best of my ability and knowledge...

As someone above has mentioned...your TPS application has nothing to do with H1\H4 status.
As long as you have all the documents and you have not violated any H1 status i don't think there is any thing to worry about. But prepare to answer question if they asked you.
Also H1 is a dual intent status (non-immigrant and immigrant) so they cannot reject or deny entry at port of entry because of immigrant intent.
Also you said you are going for re-stamping which means you have already got visa the 1st time. SO i don't think you will have any issues. At port of entry you will be entering in H1\H4 status so your TPS has nothing to do with it.
Make sure not to hide any information during filing visa application process ...

I know right :) @Haina ho Serey, Phoolbari bro thanks for ur suggestion, i did ask the question on avvo.com and it did help.Thanks to @edipre and @STUPIDA as well. I spent $60 bucks on a local immigration lawyer, he did not have an effin clue what i was talkin bout, he had only dealt with TPS w/ ppl who got here jumping the fence. Spent another $39 over the phone consultation with another who kinda told me what i already knew. Best piece of advice was from an attorney on avvo.com for free. lol no wonder i love free stuff. Thanks Ya'll
