Hey Frenz,
I need some genuine suggestions as some of you might have gone through same situation.
I have my H1B approved on October last year and I have been with current consultancy since July 2015. Before that, I was working through another consultancy. They are ready to start my GC (probably on EB2). I have MS degree from US, almost 2 years experience through consultancy, and around 4 years experience from Nepal. My current position is Software Developer which was petitioned for H1B. I am thinking of applying on EB2 with Sr. Developer.
1.Based on above circumstances, am I eligible for EB2 category (I heard that I need to have 3 years experience + MS degree for EB2).?
2) As I do not have good relationship with previous employer (dhoti consultancy), not sure if they give me experience letter as desired. I have paystub and a letter which verifies that I had been working with them. Would that be enough to show on my experience from them or I need specific format experience letter from them?
3) What additional things I have to consider?

why do you want to go with EB2 and be in trouble with all the experience letter and other stuffs? for country like Nepal..EB2 and EB3 takes almost the same time...so just jump onto the EB3 before wasting time on searching for the experience letter for EB2.

Based on your information, better to proceed EB3 (not EB2) ( I think).

You would definitely require the experience letter from your previous employer whether you choose EB2 or EB3. EB3 would be a better choice rather than to stick into RFE and audit later on.

Normally, your previous employer will give you the experience letter, I do have the same situation like yours, not a good relationship, but eventually if you follow up and make two three calls every week and bother them, they will give you the letter at the end of day. But remember, you need the experience letter from Previous employer.

Thanks everyone.
Ohio,
I have the paystubs, and a letter from them when I was travelling back home in past. So, they must have to provide experience letter. Only my concern is do I really need experience letter from client for which I worked through previous employer?
Also, is there any specific format that I can ask them?

You do not need experience letter from the Client in this scenario, because your pay stub shows your previous employer name only. No need to worry at all for the client letter. You just need to get the letter from your previous employer only who will be considered as your employer for Green Card Processing to count your previous experience.

All,

For EB2, along with Master degree, is it a requirement to have atleast 3 years of experience?

Prem101 eb2 master degree can be with 0 yrs of experience. It's depends on the employer job description.
