TPS-Pending in local office
Hello everyone, does anyone have the same issue like mine. me and my friend both had our Biometric on Sep 3rd 2015. She got her EAD on Sep 13th 2015 but mine is still saying "Pending on Local USCIS office".
Does anybody have same issue. Is it due to the asylum case that i had.
thanks.
@u4unique,
hello brother,
I think we are in same boat. My asylum interview is cancelled because of TPS filing, saying that file transferred to TPS center. Did you get TPS decision by now? If yes, how long did u have to wait after fingerprinting.
I am just waiting to get TPS decision so that my file comes back to asylum office.
I didn't apply for EAD.
@sachin bhai
Hello brother, looks like I have the same situation as yours. I filled TPS and it's still pending and my asylum interview is next week. I haven't been inform about cancellation or any notice about it. How did you knew about your cancelled interview and is it everyone interview cancelled who has filled for TPS?
Thank you.
@kumud,
the asylum officer informed my attorney. they inform that my file was transferred to TPS center.
when did u have your biometrics for TPS?
was your TPS processed by Nebraska service center?
I don't know if it happens with everyone.
lets be in touch so that we remain updated
@sachin bhai
Thanx for getting back brother, I got my biometrics on dec 21 2015 and it's processing from Nebraska service center. My asylum interview is in San Francisco. Is your timeline similar as mine? At the time was your interview was scheduled and got cancelled and have they let you know the tentative date of your next interview?
Thanx.
@Kumud
my case was also in san Francisco.
my status-
finger print fee received for TPS -dec 16 ( still stucked on the same status)..didn't apply for EAD.
finger print for TPS appt.. jan14 ( But they took it early when I was in biometrics center for some other reason..Jan 8)
asylum interview scheduled was Jan 13..but cancelled by phone on Jan 6 to my attorney and later sent notice also...no new date.
can you share your timeline so that we can estimate how long they take to process?
thx
@sachin bhai; looks like we have similar timeline. We can discuss in detail, here is my email address: chiveon9@gmail.com
Thanx
@sachin bhai
I applied TPS around November end and fingerprint on dec 21. I applied for EAD. My interview on Jan 27 since I haven't hired an attorney, uscis haven't relayed any msg or letter notifying the cancellation of interview. Your n mine timeline is similar, if we have information we can share and make it little easier for us. I Will update on my status as it happens.
Peace.
Something is not right. Asylum case should be independent of TPS. Here is what USCIS says:
Question: If a person already has an asylum application and has already applied for an
Employment Authorization Document (EAD) through asylum, should that person still apply for
TPS?
Answer: An individual may apply for TPS while having a pending asylum application. In some
cases, applying for TPS, in addition to asylum, may be best because the person might lose the
opportunity to file for TPS if he or she does not apply during the 180-day TPS registration period
that ends on September 25, 2012. If the person already has an EAD due to a pending asylum
application, he or she does not need to apply for an EAD when filing for TPS. The applicant,
however, must submit both the Form I-765 (without EAD fee) along with the Form I-821 and any
fee, or fee waiver request. If the person is granted asylum as well as TPS, it is not necessary for
him or her to re-register for TPS if the designation is extended since he or she will have asylum,
as long as the person does not fail to maintain asylum status.
If you prefer to see whether your asylum application will be granted or denied before you apply
for TPS, you may be able to file late for TPS, provided that: (1) the Secretary does extend TPS
for Syria beyond September 30, 2013, and (2) you file during the extension period and within 60
days of the date that your application for asylum was denied. If, however, your asylum
application is denied before any extension period for TPS Syria is announced and the initial
registration deadline has passed, you may not be able to apply for TPS.
If you have questions about whether you should file for asylum, TPS, or both at the same time,
we encourage you to consult with a private immigration practitioner or recognized immigration
organization for further advice specific to your situation.

I talked to my attorney before i applied for TPS while having pending asylum, he said there will be no effect on one or another due to this. my guess would be if one is stilll maintaining valid status other than pending asylum or TPS then it could be different scenarios.. now the scheduled interview being cancelled is something unexpected.. worried... keep ur updated sachin bhai, kudum and others..
some of the immigration lawyers I consulted told me that all our immigration files are combined.
So my assumption is that although filing TPS application doesn't affect Asylum application, but it does affect the timing of interview or timing of decision if they overlap.
Guys, no body has definite answers. So keep consulting and posting whatever information you come across. Some lawyers are not aware of even what is written in the USCIS authentic websites. So the best way of knowing is getting information directly from the applicant, So keep asking your friends who are in the same boat and plz share in this thread.
