Namaste,

I applied for asylum lately and waiting for interview date letter after giving biometrics. I was wondering can I still apply for TPS now? Or that would contradict my purpose of asylum and put me into trouble? If someone could shed some lights here, i'd heartily appreciate it. Thanks!

Since you have already given biometric, you get EAD sooner than EAD from TPS. So TPS is temporary but Asylum, if approved is permanent. So, I do not see any benefits of applying for TPS. If you think you get advance parole though TPS and travel to India (?? actually to Nepal), then you are risking yourself travelling while Asylum is under processing. So, its your choice.

Can you apply for TPS ? Yes you can. There is no immideate benefit of TPS for assylee. However considering the fact TPS designation has been renewed multiple times for most countries it can be a good back up plan. Say in future(worst case scenario) if your asylum case gets denied & you don't have a status ie: f1, h1 or what ever you can work, study & stay here if you have TPS.

@neerman.. Thanks for your suggestion. Considering the low approval rate in asylum nowadays,I just wanted to keep TPS as back up plan but then again, I was inclined to think if it would go against the purpose of asylum since TPS, at the moment, is meant for illegal Nepalese to go back home (please correct me if i'm wrong).

@Gundrukay.. Thanks for your advice.That's what I'm thinking at a moment and for above reason, I'm concerned to do so and I've been waiting for like 18 days but haven't received interview letter yet. Also, can't see anything while checking case status online.Maybe I'm not patient enough. Thanks again!

I would also suggest you applying for TPS, and EAD with it (if you don't have one already). Like Gundruke brother suggested, it is definitely a good back up plan. Another thing, Unless you are super lucky, Most asylum cases are being backlogged, and the waiting time frame is more than two years. Hope this won't happen to you, but if it does, TPS will benefit you in lot more ways. Like you can go to school paying only instate tuition. and definitely, AP to travel to india. Though its not recommended, I have seen people doing this and came back with no trouble.
As mentioned in USCIS website, and many Lawyers suggested, Tps will not contradict your asylum case, though you should be prepared to explain why you applied for TPS on your asylum interview, in case the officer ask you.

Though, TPS will not affect your asylum case, it might affect your interview/ scheduled date. Since, you're already protected under TPS, USCIS might push your date further. That's what my lawyer told me. I am not sure how accurate he is.
