Hello sahaj, 
One of our fren he was illegal, and got caught by the immigration officer yesterday in United States. till now he has not done any crime or involved in any criminal activities, IS there any way to release him, he has a court day tomorrow and he is locked uped by immigration officier and he has a judgement tomorrow. What is the way to release him ?

Do anyone know the law regarding this and Is Immigration lawyer can help anything or release him at any means?


Any suggestion will the appreciated

 was he caught while working? did he quit school and overstayed? there should be a way to bail out and i would definitly look for a lawyer meanwhile.  what state did this happen anyway

 He was out of status for real long time and caught while travelling in Greyhound Bus. I am trying to find which immigration jail is he now exactly. and i talked to the the lawyer and refused to handle the case since he has been illegal for a real long time. I am not able to find him, where exactly is he now

When the ICE catches you for being illegal, they arrest you and issue a Notice to Appear. If he doesn't have criminal record, then he can be bailed out. The standard bail amount is $5000. He can request a bail hearing before the judge, and request to lower the bail amount due to financial hardship and the judge can lower it to as low as $1500. They cannot deport him right away. You have rights in this country. Only an immigration judge can make the decision on his deportation. Ask him not to talk to ICE. Tell them you want to exercise your right to be silent and ask for an attorney. There is a 24 hour hotline number which can located where your friend is detained. You will need to know his A number though, which is assigned to him when they issue NTA.

 By the way, if you are illegal, it is way much safer to travel by air than use greyhound or private car. Border patrol has different checkpoints inside the US looking for narcotics and illegal aliens on the 100 miles radius of the southern border.

what would you show to travel by air? passport with expired visa? is it safe?

 i wonder if he was going to niagara falls..thats the only place i have heard that would might checked of your status... otherwise its rare that they would check your status in greyhound...they hardly check your id to get in bus..all you need is a bus ticket

Any ID with your picture on it is acceptable at the airport while travelling domestic.
Yes, unexpired passport will do. They don't even look at the visa. All they check is the name on the ticket and the identidication document is the same. You can even show Nepal's driving license. 
I have once travelled with a debit card with my picture on it. I lost my passport and I didn't have a US driver's license at that time.

 You should come to San Diego and there are many checkpoints on I-8 being close to the border. They ask if you are a US citizen. If the answer is no, you will face secondary inspection where they check your status. Out of status are being detained. It has happened a lot in Arizona, Texas, and California.
