 Hi guys,
I need  help and suggestion. I took training wid an indian consultancy and there marketing was not to the standard level so I stopped marketing from them. They had me sign a contract to work with them for a year. However I have not been placed. agency is sending me mails saying that they are going to sue me for ditching their contract. What do I need to do? i need help.. Do i need to look for a lawyer?
Thanks

In your own defense, you can always say you find their approach highly unethical, prompting you to ditch 'em. They'll have no other choice than to bog off.

Hey,
This is US man. No employer can force you to work in this country by any mean. Can you please post a letter in this thread?

If i were you, I would just give a f*** to them and move on. They can't do anything to you.

NO EMPLOYER CAN FORCE YOU TO WORK IN THIS COUNTRY. PERIOD!!

Don't worry buddy. Those fake indian consultancy can't do an ant harm to you. Those contracts are all fake and not legal in court. I have been in similar situation and moved on. They know it will cost them their business if they even think about suing fake resume consultant.
Don't worry move on and good luck.

For those saying how he'll be fine, do you guys actually know what you're talking about (as in speaking from experience) or arbitrarily saying that? I mean, there's gotta be a reason why you're asked to pen a contract. Surely, you're not asked to sign a contract just to create some fear or paranoia.

@ riddle, did you read my full post. I specifically said "I have been in that situation and moved on." Which means I was one of junk_truck back then. Therefore, information in Shaja comes from experienced people.

If there is a valid contract, yes, they can sue you.

Follow riddle's advice. Tell them that you are going to report them!

 junk_truck,

This type of contract does not make any sense, they just do this for the OPT holder, so that they can put you in pressure and make some money from you. You will not be in trouble. Just ignore their emails, phone calls, letters etc.. They will never sue you, If they sue you, judge will rule them to pay the salary of your time with them.

Forget about this consultancy and move on.....

Thought of not jumping into this thread...but a lot of misinformation flowing. I am trying to make it short.

Can they sue: pretty much any one can sue any one.
Will they sue: most of the time no, if stake or money is not much, some time they do to show others that they can sue.

Will they win case- depends.

What is the best choice: quit in good grace, evaluate risk vs benefit.

Any thing better to know: most of the court case are public record , try to find if ur company have sue any one in past. If your company is small chances are high they won't. But if they be ready to defend.

And one more thing , case won't be for forceing u to work, but will be for monetary compensation , which is very valid on any written contract.

Junk_trunk: as many experienced have posted in this thread, I also do confirm 100% that those Indian or just any employer in the US, for that matter, can NOT force you to work for them if you are unwilling to. It does not matter if you signed however many contracts with whatever conditions, but if you do not want to work for anyone, they cant force you!

I know this through a formal legal education/training - in short, you can leave your employer whenever you want, for any reason or no reason (even though you are in H1B). Likewise, your employer can fire you for any reason or no reason at all. It goes both ways! So nothing to worry about.

Good Luck!
