Hi,

I have tps and student visa and I was not and I am not working while going to school. I have been filing taxes and following all the rules.

But Can I still file for unemployment benefit getting from COVID without affecting my green card processing in the future if I got an opportunity to apply? Will it consider as a public charge and is there a way to get pay back?

Please share any information that will be very helpful.

Write Clearly and Correctly so people can understand and respond Clearly and Correctly.

You said, "I was not and I am not working.." " I have been filing taxes.."

What a conflict statement.

IF you have NO income, however, you aren't obligated to file tax.

Or you meant to say you have W2s for the year 2019, and you're unemployed the whole year of 2020.

Clear this out first what you meant to say, and by the way, and please mention, where do you live?

PLEASE NOTE: TPS holder can file for unemployment and it is NOT under public charge regulations.
